Common use of Tree Preservation Clause in Contracts

Tree Preservation. Developer shall replace any and all trees that are removed as part of the construction of the Project with the appropriate number of new trees pursuant to the City’s Tree Ordinance. Developer shall cause the Project to maintain said trees in an appropriate manner pursuant to the City’s Tree Ordinance. Developer shall not be required to mitigate for trees that need to be removed that are on City property.
