TRUSTEE NOT RESPONSIBLE FOR RECITALS, ETC. The recitals contained herein and in the Notes and the Guarantees, except the Trustee’s certificate and the representation as to the power of the Trustee to enter into this Indenture and accept and execute the trusts hereby created, shall be taken as the statements of the Company and the Guarantors, and the Trustee assumes no responsibility for the correctness of the same. The Trustee makes no representations as to the validity or sufficiency of this Indenture or of the Notes other than its certificate of authentication. The Trustee shall not be (i) accountable for the use or application by the Company of any of the Notes or of the proceeds of such Notes, (ii) accountable for any money paid to the Company, or upon the Company’s direction, if made under and in accordance with any provision of this Indenture, or (iii) responsible for the use or application of any money received by any Paying Agent other than itself.
