Common use of Unaffiliated Third Parties Clause in Contracts

Unaffiliated Third Parties. Nothing herein shall impose any duty upon the Fiscal Agent in connection with or make the Fiscal Agent liable for the actions or omissions to act of unaffiliated third parties (other than subcontractors referenced in b. above) such as, by way of example and not limitation, airborne services, delivery services, the U.S. mails, and telecommunication companies, provided, if the Fiscal Agent selected such company, the Fiscal Agent exercised due care in selecting the same. 39
