Common use of Uncorrected Defects Clause in Contracts

Uncorrected Defects. 36.1 If the Contractor has not corrected a Defect within the time specified in the Engineer‘s notice, the Engineer will assess the cost of having the Defect corrected, and the Contractor will pay this amount. (1) Where in certain cases, the technical specifications provide for acceptance of works within specified tolerance limits at reduced rates, Engineer will certify payments to Contractor accordingly. (2) Where the failure to correct a particular defect within the specified time is considered as a fundamental breach of contract, a notice should be given to the contractor as stated in G.C.C. 59.2(2) 37.1 The Bill of Quantities shall contain items for the construction, installation, testing, and commissioning work to be done by the contractor. 37.2 The Bill of Quantities is used to calculate the Contract Price. The Contractor is paid for the quantity of the work done at the rate in the Bill of Quantities against quoted price.
