Under the Influence of Alcohol. A person is deemed to be under the influence of alcohol if test results show an alcohol concentration of .04 (point zero four) or more based upon the grams of alcohol per one hundred (100) milliliters of blood, or if a breath alcohol test result is .04 (point zero four) or greater. A confirmation test will be administered fifteen to twenty (15-20) minutes after the first test. If the second test result is negative, then the first test results shall be deemed negative.
