Common use of Unresolved Disputes Clause in Contracts

Unresolved Disputes. Any dispute under this agreement not resolved by Section 24.9.1 shall be settled within the court system in the United States of America in any court with jurisdiction over the agreement and/or the parties, pursuant to the laws of the United States at the time of the conflict. In no event shall a conflict under this agreement be settled in any jurisdiction other than the United States, nor shall disputes be submitted to mediation, arbitration, or any other alternative dispute resolution procedure unless: (1) The Members unanimously agree to submit the issue to mediation, arbitration, or any other alternative dispute resolution procedure; or (2) A court orders mediation, arbitration, or another alternative dispute resolution procedure.
