Common use of Unsafe Working Conditions Clause in Contracts

Unsafe Working Conditions. (a) No Employee shall be disciplined for refusal to work on a job which is deemed unsafe by: (1) a member of the Occupational Health and Safety Committee, or (2) a person designated by an Occupational Health and Safety Committee, or (3) the Safety Officer, after an on-site inspection and following discussion with a representative of the Employer, and where it does not meet the standards established pursuant to the Workers’ Compensation Act. (b) Employees who are affected by the above provision shall be paid full salary and shall be assigned other duties.
