Common use of UP TIME Clause in Contracts

UP TIME. An employee who reports for work on schedule and is informed that no work is available, shall be paid four (4) hours at his applicable rate and all other applicable benefits. He may, however, be required to perform other work his trade as directed by the Contractor or his representative. If an employee has started work and the work cannot proceed, the employee so affected shall receive his applicable rate of pay for the time spent working on the job, but no less than four (4) hours pay, and all other applicable benefits. He may, however, be required to perform other work of his trade as directed by the Contractor or his representative. An employee who because of failure of the Contractor to inform him during working hours, that no work is available or because he has been instructed to report by the Contractor or his representative, reports for work on schedule and is informed that no work is available shall be entitled to be paid a minimum of four (4) hours at his regular rate.
