Usage Review. Dremio or its designated agent may audit Licensee’s use of the Software, upon notice to Licensee, for purposes of ensuring compliance with this Agreement, provided that Dremio provides a request for such audit in writing at least ten (10) days prior to such audit. Licensee agrees to cooperate with any such audit, which shall be conducted during Licensee’s regular business hours. Provided it does not identify Licensee, Dremio will be free to use for development, diagnostic and corrective purposes any data and information it so collects relating to diagnosis, problems, systems, performance, use or functionality, and may allow others to do so.
Usage Review. Firefly Fiber Broadband reserves the right to review usage of all its plans to ensure you are not abusing them. You agree to use Firefly Fiber Broadband Services for normal voice or fax calls and will not employ methods or equipment to take advantage the Services by using the voice or fax services excessively or for means not intended by Firefly Fiber Broadband. Firefly Fiber Broadband may terminate Service immediately if it determines, in its sole discretion, you are abusing its plans. We reserve the right to at any time enforce this policy. For subscribers where usage to high cost areas (for example such as calls to rural numbers, Alaska or Hawaii) exceeds 5% of total call traffic, or more than 5% of call volume lasts less than 10 seconds, such usage may be deemed excessive in the sole discretion of Firefly Fiber Broadband. For such usage, you agree to pay a per minute or per page fee surcharge in excess of established levels at the current Firefly Fiber Broadband rate. The surcharge is currently $0.03 per minute and/or $0.03 per fax page. This surcharge applies to all plans, including the unlimited plans. Alternatively, in the sole discretion of Firefly Fiber Broadband, your Service may be immediately terminated.
Usage Review. Client shall, during the Term, maintain full and accurate records (including applicable data in electronic format) with respect to access to and usage of the Services. During the Term and for 24 months thereafter, CDI and each Third-Party Content Provider shall have the right, during normal business hours, upon reasonable notice to Client and subject to Client’s reasonable security procedures, to (a) review relevant portions of those records; and (b) review the manner of access to and usage of the Services, in each case to confirm that fees and charges have been accurately determined and that restrictions on use and access have been observed. In connection therewith, Client agrees, at Client’s location, to permit CDI or its representatives to review or receive a demonstration of, any network on or by which any portion of the Services is accessed, used, or stored, for purposes of establishing compliance with the terms of this Agreement. The costs of any such review shall be borne by CDI unless such review reveals a breach of the terms and conditions of this Agreement by Client, in which case the costs of such review shall be borne by Client. Without limiting the foregoing, an authorized representative of Client shall, at CDI’s request (which shall not be more than once per calendar year), promptly provide a written certification of Client’s full compliance with this Agreement. CDI may use information obtained by CDI from its own systems or a distributor to verify access to and use of the Services by Client. Client agrees to promptly pay CDI the prorated difference, if any, between the amount of fees actually charged Client by CDI and the amount that should have been charged. Usage Review. Bizagi may review, at its own expense, End User’s use of the Services to assess whether such use is in accordance with this ▇▇▇▇ and to ensure End User’s compliance with the terms of this ▇▇▇▇ or the terms of the agreement between End User and the Bizagi Authorized Reseller. The End User agrees to cooperate with ▇▇▇▇▇▇’s review and provide reasonable assistance and access to information. Any such review shall not unreasonably interfere with the End User’s normal business operations. Any discrepancies found in such review may result in a charge to the End User. Bizagi will issue any such invoice to the Bizagi Authorized Reseller, which will in turn invoice such charges to the End User. Any disputed charges will be resolved through the Disputes clause at FAR 52.233-1.

For the purpose of clarity, but in no way limiting the definition of abusive use of Services, auto-dialers, continuous call session connectivity, fax broadcasting, fax blasting, mass calling or any other blasting activities are conclusively presumed to be abusive use of the Services. If Momentum has reasonable suspicion that Customer may be in violation of the foregoing prohibitions, Momentum in its sole discretion may take curative action that may result in the modification, suspension or cancellation of some or all of Customer’s Services.

You agree to use unlimited minute plans for normal voice or fax calls and will not employ methods or equipment to take advantage of unlimited plans by using the voice or fax services excessively or for means not intended by Momentum. Momentum may terminate service immediately if it determines, in its sole discretion, you are abusing the unlimited minute plan.
Usage Review. 9.1. The Licensor shall have the absolute right to review the extent of usage of the Software by the Licensee and its Representatives, without any prior notice (“Usage Review”). Such Usage Review can be conducted at any time by the Licensor, by way of one of the below options exercisable at the discretion of the Licensor:
(a) remote surveys; or
(b) audits conducted by the Licensor itself or a third party, whether remote or on-site.
9.2. The Licensor may at its discretion, instead of requiring a Usage Review, require the Licensee to make voluntary disclosures regarding its use of the Software.
9.3. The Licensee shall provide all cooperation and assistance to the Licensor or any authorized representatives of the Licensor, for conducting such Usage Review, including but not limited to providing unrestricted access to the Licensee’s systems.
9.4. In the event the Licensee refuses to cooperate for the Usage Review, or the Usage Review reveals an over-usage of the Software when compared to the License procured, or non-compliance with the terms of this Agreement, the Licensor shall in addition to the right to terminate this Agreement and the License provided, be entitled to charge the Licensee the following:
(a) an amount equivalent to twice (2x) the license fees applicable for the additional users detected during the Usage Review;
(b) all the costs incurred for the Usage Review; and
(c) a penal interest calculated on the existing license fees for the breach of the terms contained in this Agreement, at a rate to be determined by the Licensor.
Usage Review. Telemitra reserves the right to review usage of all its plans to ensure you are not abusing them. You agree to use Telemitra Services for normal purposes and will not employ methods or equipment to take advantage the Services by using the services excessively or for means not intended by Telemitra. Telemitra may terminate Service immediately if it determines, in its sole discretion, you are abusing its plans. We reserve the right to at any time enforce this policy.
