Common use of Use and Disclosure of PHI Clause in Contracts

Use and Disclosure of PHI. Except as otherwise permitted by this Agreement or applicable law, Business Associate shall not use, disclose or make amendment to PHI except as necessary to provide its services to Covered Entity as set forth in the an agreement for services between the Parties or as expressly authorized herein, and shall not use or disclose PHI that would violate the Privacy Rule if used or disclosed by Covered Entity.

Use and Disclosure of PHI. Except as otherwise permitted by this Agreement or applicable law, Business Associate shall not use, disclose or make amendment to PHI except as necessary to provide its case management software product and services to Covered Entity as set forth in the an agreement for services between the Parties Parties’ Master Service and License Agreement or as expressly authorized herein, and shall not use or disclose PHI that would violate the Privacy Rule if used or disclosed by Covered Entity.

Use and Disclosure of PHI. Except Business Associate shall not use or further disclose PHI other than as otherwise permitted by this Agreement or applicable as required by law, or if such use or disclosure does not otherwise cause a Breach of Unsecured PHI. To the extent practicable, Business Associate shall not limit its use or disclosure of PHI or requests for PHI to a limited data set, or if necessary, to the minimum necessary to accomplish the intended purpose of such use, disclose disclosure or make amendment to PHI except as necessary to provide its services to Covered Entity as set forth in the an agreement for services between the Parties or as expressly authorized herein, and shall not use or disclose PHI that would violate the Privacy Rule if used or disclosed by Covered Entityrequest.
