Use and Operation of the Premises. DNREC agrees that the Vendor shall and peaceably may occupy, manage, operate and maintain the Venue, including their respective buildings throughout the License Term. The Vendor shall provide any and all material, tools and equipment that it deems necessary to the management, operation and maintenance of the Venue as Public Outdoor Recreation Services available for use by the general public on a nondiscriminatory basis throughout the term of this Agreement. Houses and apartments included in the Venue may be utilized by the Vendor for staff housing, provided however that (1) such use is in accordance with all applicable law, and (2) Vendor shall ensure the houses and apartments be fully vacated on or before the termination or expiration date of this Agreement. In no instance shall houses and apartments be leased to the public. They must be related to the service of the business.

Use and Operation of the Premises. It is understood and agreed that the Licensee is hereby granted its license for the sole purpose of conducting and operating its sailing programs for the 2024 season and to store equipment associated therewith. The Licensee shall be permitted to conduct a floating dock to the shore as depicted on Schedule A. Participants, coaches, guests, and invitees of the sailing programs will be permitted to enter the dock from the right-of-way area immediately to the east of the bathhouse. The Licensee shall be permitted the exclusive use of the area of the bathhouse depicted on Schedule A for storage of its sailing equipment. The Licensee shall make no alterations to any portion of the Premises, including to the area of the bathhouse necessary for secure storage of the Licensee's sailing equipment, without first obtaining the written consent of the Village. The Licensee agrees to keep the restrooms located in the bathhouse open to the public whenever ▇▇▇▇▇▇▇ Park is open and the licensee is conducting programs and to maintain the restrooms in a clean and sanitary condition at the Licensee's sole expense during the term of the Agreement. The Village is responsible for keeping restrooms stocked with toilet paper and hand soap. The Licensee shall ensure that the bathhouse is secured at the end of each day's activities.

  • DESCRIPTION OF THE PREMISES Prior to, or during the first month of the effective use (transfer of keys) of the rented property and whenever important alterations have been made to the rented property during the rental period, both parties are obliged to draw up a detailed and contradictory description of the property at their joint expense. If one of the parties so requests, the parties will draw up a detailed and contradictory description of the premises at their joint expense at the end of the rental period. In the absence of an initial description of the premises, the tenant is deemed to have received the property in the condition in which it is in at the time they leave, except if the necessary proof to the contrary is provided. The same applies if no final description of the premises has been drawn up by the end date of the contract. After signature by the contracting parties, the description of the premises will be appended to the present agreement. The lessor has the right to make the reimbursement or release of the deposit dependent on the drawing up of the final description of the premises in the presence of the tenant or their representative, at a mutually agreed time. The lessor will make every effort to be present at this description of the premises at a reasonable time.
