The 'Use of Documentation' clause defines how parties may access, utilize, and distribute documents or materials provided under an agreement. Use of Documentation. Subject to the other terms of this Agreement, Converge and the Converge Subsidiaries may access and use the Documentation, including by private-labeling said Documentation and by excerpting and/or modifying portions thereof in a manner that is not confusing or misleading, solely in connection with their use (including ancillary uses, such as training, marketing and promotion, etc.) of the Products as permitted under this Agreement.
Use of Documentation. 7.01 During the Term, DSTTI hereby grants to Pioneer, the non-exclusive right to reproduce, transmit, distribute, display, adapt, and incorporate the Documentation solely into Pioneer's internal training materials (the "Training Materials") and solely in connection with Pioneer's internal use of the System. Such Training Materials may not be disseminated outside of Pioneer. Pioneer agrees that any Training Materials that incorporate the Documentation shall contain or refer to the copyright or proprietary notices as provided on the AWD Customer Center. Any use of the Documentation by the Pioneer in a manner not expressly authorized by DSTTI or in breach of any terms of this Schedule constitutes copyright infringement, entitling DSTTI to exercise all rights and remedies available to it under copyright laws around the world. 7.02 Pioneer acknowledges and agrees that DSTTI cannot ensure the editing or proper adaptation and incorporation of any Documentation into Pioneer's Training Materials. Pioneer agrees that DSTTI has no liability for any action or inaction with respect to the Documentation content as incorporated into such Training Materials, including updating or failing to update any such Training Materials such updated Documentation. 7.03 Under no circumstances shall DSTTI be liable for any damages whatsoever, whether direct, indirect, incidental, consequential, special, or exemplary (even if DSTTI has been advised of, or has foreseen the possibility of such damages), arising from the access, use, or inability to access or use the Documentation as incorporated into the Training Materials, including, without limitation, claims for loss of revenue or anticipated profits or lost business. 7.04 DSTTI reserves the right, but has no duty, to review the Training Materials. 7.05 Pioneer shall maintain readily accessible and readable copies of the Training Materials during the Term of this Schedule. Upon written request from DSTTI, Pioneer shall promptly make available all Training Materials incorporation the Documentation.
Use of Documentation. Danger grants to Motorola and its Third Party Contractors a perpetual, worldwide, non-exclusive, fully paid-up license to use, display, distribute, reproduce, have reproduced, edit, translate, create Derivative Works, and modify Documentation solely for the purpose of developing, manufacturing, distributing, marketing or repairing Products.
Use of Documentation. Customer may use and copy the Documentation as reasonably necessary to exercise its rights under this MRA, including a reasonable number of copies for training, testing, backup, and archival purposes. Use of Documentation. BiondVax may not use the documentation it receives under this Section 2.5 for any purposes other than as permitted by this Agreement, and such documentation shall be treated as Confidential Information of the Licensors, except to the extent such documentation contains and/or refers to Licensed Technology which is jointly owned by BiondVax on the one side and MPG and/or UMG on the other side. The MPI-MS (and UMG, as applicable) provides such documentation “as is”. The MPI-MS (and UMG, as applicable) shall use reasonable efforts to provide the documentation to BiondVax in a suitable form; provided, however, that the MPI-MS (and UMG, as applicable) shall have no obligation to reformat or otherwise alter or modify any such documentation, or to create documentation in electronic form, in order to provide it to BiondVax. Any and all such documentation delivered to BiondVax under this Section 2.5 is and shall remain the sole property of MPG (and/or UMG, as applicable), except to the extent that BiondVax has contributed to such documentation and provided that such documentation shall be subject to BiondVax’s rights as set forth in this Agreement.
Use of Documentation. Unless otherwise agreed by ATI in writing, all documentation, including Specifications, delivered pursuant to this Agreement and all information contained therein may be reproduced only for inspection, testing, maintenance and repair purposes. Neither receipt nor possession of documentation delivered pursuant to this Agreement confers or transfers any right to use, reproduce or disclose the documentation, any part thereof, or information contained therein, for any other purpose. The foregoing restrictions shall not apply to documentation clearly intended for use by end users.
