Common use of Use of Drugs Clause in Contracts

Use of Drugs. An employee shall not report for duty or remain on duty when the employee has used a drug or drugs, except when the use is pursuant to instructions of a physician who has advised the employee that the substance does not adversely affect the employee's ability to perform the duties and responsibilities of the job. Employees who are taking a prescription or over-the-counter medication that may impair their ability to perform their duties safely and effectively must provide written notice to their supervisor from their physician or pharmacist regarding the potential effects of such substances.
