Use of Isolation, Seclusion and Restrictive Measures. The MCO shall comply with, and as needed, provide training for its providers in compliance with the following requirements: a. The MCO and its subcontracted providers shall follow the Department’s written guidelines and procedures on the use of isolation, seclusion and restrictive measures in community settings, and follow the required process for approval of such measures (▇▇▇▇://▇▇▇.▇▇▇.▇▇▇▇▇▇▇▇▇.▇▇▇/bdds/waivermanual/app_r.pdf). b. The use of isolation, seclusion and restrictive measures in licensed facilities in Wisconsin is regulated by the Department’s Division of Quality Assurance. When subcontracted providers of the MCO are subject to such regulation, the MCO shall not interfere with the procedures of the Division of Quality Assurance. c. The MCO and its subcontracted providers shall comply with ss. 51.61(1)(i) and 46.90(1)(i) of the Wis. Stats., and s. DHS 94.10 of the Wis. Admin. Code in any use of isolation, seclusion and restrictive measures.
