Common use of Use of Payment Clause in Contracts

Use of Payment. The Additional Annual Payments are intended to be used, at the County’s sole discretion, to (a) assist the County in addressing capital needs set out in the County’s (i) capital improvement plan, (ii) current fiscal budget or (iii) fiscal fund balance and/or (b) support broadband (as defined in Code of Virginia § 56-585.1:9) funding, all as permitted by Code of Virginia § 15.2-2316.7.
