Common use of Use of Purchaser Name Clause in Contracts

Use of Purchaser Name. Except in the Registration Statement, the Prospectus and as may be required by applicable law or regulation, the Company shall not use the Purchaser’s name or the name of any of its affiliates in any advertisement, announcement, press release or other similar public communication unless it has received the prior written consent of the Purchaser for the specific use contemplated or as otherwise required by applicable law or regulation.

Use of Purchaser Name. Except in the registration statement (“Registration Statement”) and the prospectus (“Prospectus”) that may be filed to register the Purchased Shares and the Warrant Shares, the Prospectus as provided below, and as may be required by applicable law or regulation, the Company shall not use the Purchaser’s name or the name of any of its affiliates in any advertisement, announcement, press release release, or other similar public communication unless it has received the prior written consent of the Purchaser for the specific use contemplated or as otherwise required by applicable law or regulation.
