Use of SITE by Others. The SITE and approach facilities are to be used by CONTRACTOR with due regard for the requirements of NATIONAL and others permitted by NATIONAL to use same. If it becomes necessary to move the materials or facilities of CONTRACTOR, it shall be done upon request of NATIONAL at the expense of CONTRACTOR unless the request involves a movement from a previously approved area. NATIONAL may install and operate equipment and machinery or otherwise use and occupy the SITE during the progress of the WORK, provided that NATIONAL does not unreasonably interfere with the prosecution of the WORK under conditions originally contemplated.

  • Use by Others Forest Service shall have the right to use any road constructed by Purchaser under this contract for any and all purposes in connection with the protection and administration of the National Forest. Other parties, in connection with the logging of tributary National Forest timber, may use roads constructed by Purchaser hereunder when Contracting Officer determines that such use will not materially interfere with Purchaser’s Operations. Third party use shall be contin- gent upon Contracting Officer determining, and third party agreeing to pay, a fair share of maintenance cost com- mensurate with such commercial use. (a) Contracting Officer makes appropriate arrange- ments to relieve Purchaser of related maintenance costs commensurate with such other uses and (b) Such other uses will not materially interfere with Purchaser’s Operations. Where Purchaser reconstructs a road having estab- lished use, Purchaser’s use during reconstruction and thereafter shall be such as to reasonably accommodate such established use. Contracting Officer shall ensure that other users do not materially interfere with Purchaser’s right to use such reconstructed road.

  • Use of Site 4.13.1 The Contractor shall confine operations at the site to areas permitted by law, including areas designated for operations or prohibited from operations by any applicable permit and or regulation, ordinances, permits and the Contract Documents and shall not unreasonably encumber the site with any materials or equipment.

  • Use of Space The COUNTY will provide the space located at: [insert Orange County Government Location] (the “Designated Space”) which shall be utilized by the AGENCY solely for the lawful purpose of providing the services. If no space is designated, this Article V does not apply.

  • Use of Data by User Registry Operator will permit user to use the zone file for lawful purposes; provided that (a) user takes all reasonable steps to protect against unauthorized access to and use and disclosure of the data and (b) under no circumstances will Registry Operator be required or permitted to allow user to use the data to, (i) allow, enable, or otherwise support the transmission by email, telephone, or facsimile of mass unsolicited, commercial advertising or solicitations to entities other than user’s own existing customers, or (ii) enable high volume, automated, electronic processes that send queries or data to the systems of Registry Operator or any ICANN-­‐accredited registrar.
