Common use of USE OF THE HOME Clause in Contracts

USE OF THE HOME. Occupying the Home 5.1 You must occupy this property as your only or principal home. 5.2 You must tell us in writing if you will be away from home for more than a month. You must make sure your home is safe and secure while you are away. In the cold weather, you should turn off the water supply and drain the heating and hot water systems – you should get professional help if you are not sure how to do this. 5.3 You must not sub-let the whole of your property. If you are a secure tenant you have the right to sub-let part of your home but you must get our written consent first. Sub-letting means that someone pays you rent to have exclusive right to part of your home. They will usually do their own cooking and cleaning. 5.4 If you are a secure tenant you have the right to take in lodgers save for tenants who occupy sheltered accommodation when it is only the tenant or their named partner who can occupy the home, or that of the tenant and 1 other person (such as an identified family member/friend/carer) by way of a short-term arrangement only and subject to approval of sleeping arrangements. You must inform us in writing if you do so. A lodger is someone who lives in your home but doesn't have exclusive right to any one part of it. He or she will often get some sort of service from you such as cooking and cleaning.
