Common use of Use of the Premises Clause in Contracts

Use of the Premises. Lessee agrees to use said Premises for the limited purpose of conducting its religious services and other related activities, as enumerated below, and for no other purpose. a) Lessee’s religious services and related activities shall consist of: Lessee agrees not to use said Premises for any other purpose without the prior written consent of Lessor. Lessee also agrees to use said Premises only during the following times: - AM to PM. - AM to PM. - AM to PM. Lessee agrees that it shall not use the Premises at other times without the prior written consent of Lessor. b) After each use of the Premises Lessee agrees to: (1) Return all chairs, tables, and other furniture used for its church services to their prior location or arrangement and in good order. (2) Clean the kitchen floor, sinks, counter tops, and other kitchen equipment or furniture, after Lessee's use of the kitchen area or equipment and furniture. (3) Dispose of all food remnants and other trash in the designated trash containers. (4) Turn off all lights, heating and air conditioning and kitchen appliances. (5) Lock all doors. c) Lessee shall have the right to use parking spaces or parking areas near or adjacent to the Premises that are designated by Lessor for the use of Lessee and its employees, guests, and invitees. All such parking shall be on a nonexclusive, non-assigned basis and shall be used only during the times specified in this agreement, and for one hour before and one hour after said designated times. Lessee shall not use or permit its employees or invitees to use any spaces which have been specifically reserved by Lessor or for such other uses as have been designated by appropriate governmental entities as being restricted to certain uses. Lessee shall at all times comply and cause its employees and invitees to comply with any parking rules and regulations as Lessor may from time to time reasonably adopt. At no time will Lessee use any parking spaces for storage or containers of any type or description. Lessor assumes no liability or risk for any damage that may occur to the automobile or other property of Lessee, its employees, invitees, or others in any parking area of the Premises. d) Unless otherwise indicated herein, Lessee shall use its own sound system. e) Lessee agrees to pay Lessor for any damage that Lessee's use may cause to any of Lessor's furniture, appliances and equipment.

Use of the Premises. Lessee agrees to (a) Licensee shall use said and occupy the Premises only for the limited purpose Permitted Use stated in the Memorandum of conducting its religious services and other related activities, as enumerated below, and for no other purposeLicense. a(b) Lessee’s religious services and related activities shall consist of: Lessee Without limiting the restrictions on use contained in this Section, Licensee specifically agrees not to use said or permit any other person to use the Premises for any of the purposes, or for the manufacture, storage, shipping or receiving (except for supplies and stock for, and other activities ancillary to, Licensee's own business); or for any purpose without other than the prior written consent Permitted Use as defined in the Memorandum of Lessor. Lessee also agrees to use said Premises only during License, the following times: - AM to PM. - AM to PM. - AM to PM. Lessee agrees that it License Agreement and its Exhibits. (c) Licensee shall not use commit any waste or allow any nuisance on the Premises at other times without the prior written consent of LessorPremises. b(d) After each use Licensee shall not place a load upon any floor of the Premises Lessee exceeding the lesser of the floor load per square foot for which it was designed to carry or, that which is permitted. Pursuant to the above, Licensor agrees to: to provide Licensee within ten (110) Return days from the information request with a list of the possible alternatives for the safe location of all chairssafes, tablesbusiness machines and mechanical equipment to be located at the Premises, and Licensee agrees not to place any of the aforementioned equipment in a location other furniture used for its church services than any of the alternatives suggested by Licensor. Such installations shall be placed and maintained at Licensee's expense, in settings sufficient, in Licensor's reasonable judgment, to their prior location or arrangement absorb and in good orderprevent vibration, noise, and annoyance. (2e) Clean the kitchen floor, sinks, counter topsLicensee, and all Persons Within Licensee's Control, shall faithfully observe and comply with all existing Licensor rules and regulations as stated in Exhibit B, as well as any other kitchen equipment that Licensor may reasonably make and may communicate in writing to Licensee, which, in the reasonable judgment of Licensor, shall be necessary or furnituredesirable for the, reputation, safety, care or appearance of the Building and the Building Systems, or the preservation of good order therein, or the operation or maintenance of the Building and Building Systems, or the comfort of Licensees or others in the Building. Notwithstanding, in the case of any conflict between the provisions of this License and any such rules or regulations, the provisions of this License shall control. Nothing contained in this License shall be construed to impose upon Licensor any duty or obligation to enforce the Rules and Regulations or the terms, covenants or conditions in any other License as against any other Licensee, and provided further that Licensor shall not be liable to Licensee for violation of the same by any other Licensee, its servants, employees, agents, visitors, invitees, sub Licensees or licensees. The right to dispute the reasonableness of any additional rule or regulation upon Licensee's part shall be deemed waived unless the same shall be asserted by service of a notice in writing upon Licensor within ten (10) days after Lesseethe giving of notice of the making of the rule or regulation to Licensee. Notwithstanding the foregoing, Licensor agrees not to enforce the Rules and Regulations against Licensee in a discriminatory manner and to use commercially reasonable efforts to enforce compliance by other Licensees in the Building with the rules and regulations contained in their respective Licenses to the extent that the failure of Licensor to enforce such compliance, shall have a material adverse impact on Licensee with respect to Licensee's use of the kitchen area Premises. Any amendment or equipment and furniturenew regulations shall become effective six (6) days after notice to Licensee. (3f) Dispose of all food remnants and other trash Licensee acknowledges that Licensor will suffer irreparable injury in the designated trash containersevent of a breach of any of the covenants it makes in this Section and agrees that, in the event of such breach, Licensor shall be entitled, in addition to any other remedies, to an injunction to restrain the violation thereof. A breach by Licensee of the covenants under this Section (after notice and the expiration of the applicable cure period) shall also constitute an Event of Default. (4g) Turn off all lights, heating and air conditioning and kitchen appliances. (5) Lock all doors. c) Lessee Licensee shall have non-exclusive use of the right Common Areas, in common with others, subject to use parking spaces or parking areas near or adjacent reasonable terms and conditions of this License Agreement and to the Premises that are designated by Lessor for the use of Lessee Rules and its employees, guests, and invitees. All such parking shall be on a nonexclusive, non-assigned basis and shall be used only during the times specified in this agreement, and for one hour before and one hour after said designated times. Lessee shall not use or permit its employees or invitees to use any spaces which have been specifically reserved by Lessor or for such other uses as have been designated by appropriate governmental entities as being restricted to certain uses. Lessee shall at all times comply and cause its employees and invitees to comply with any parking rules and regulations as Lessor may from time to time reasonably adopt. Use of the Premises. In the event of conducting its religious services and other related activitiesemergency, as enumerated below, and for no other purpose. a) Lessee’s religious services and related activities Licensee shall consist of: Lessee agrees not to use said Premises for any other purpose without the prior written consent notify Licensor of Lessor. Lessee also agrees to use said Premises only during the following times: - AM to PM. - AM to PM. - AM to PM. Lessee agrees that it shall not use Licensee's entry onto the Premises at the telephone number above as soon as practicable and shall promptly thereafter follow up with written notice of such entry. 10.2 Licensee's on-site supervisors shall retain/maintain a fully executed copy of this License at all times while on the Premises. 10.3 While on the Premises, Licensee shall use only public roadways to cross from one side of Licensor's tracks to the other. 10.4 Any contractors or subcontractors performing work on the Premises, or entering the Premises on behalf of Licensee shall be deemed servants and agents of Licensee for purposes of this License. 10.5 Under no conditions shall Licensee be permitted to conduct any tests, investigations, or any other times without activity using mechanized equipment and/or machinery, or place or store any mechanized equipment, tools, or other materials, within twenty-five (25) feet of the centerline of any railroad track on the Premises unless Licensee has obtained prior written consent approval from Licensor. Licensee shall, at its sole cost and expense, perform all activities on and about the Premises in such a manner as not at any time endanger or interfere with (i) the existence or use of Lessor. bpresent or future tracks, roadbeds, or property of Licensor, (ii) After each the safe operation and activities of Licensor or existing third parties, or (iii) the rights or interests of third parties. If ordered to cease using the Premises at any time by Licensor's personnel due to any hazardous condition, Licensee shall immediately do so. Notwithstanding the foregoing right of Licensor, the parties agree that Licensor has no duty or obligation to monitor Licensee's use of the Premises Lessee agrees to: (1) Return all chairsto determine the safe nature thereof, tables, and other furniture used for its church services it being solely Licensee's responsibility to their prior location or arrangement and in good order. (2) Clean the kitchen floor, sinks, counter tops, and other kitchen equipment or furniture, after Lesseeensure that Licensee's use of the kitchen area or equipment and furniture. (3) Dispose of all food remnants and other trash in Premises is safe. Neither the designated trash containers. (4) Turn off all lights, heating and air conditioning and kitchen appliances. (5) Lock all doors. c) Lessee shall have exercise nor the right failure by Licensor to use parking spaces or parking areas near or adjacent to the Premises that are designated by Lessor for the use of Lessee and its employees, guests, and invitees.
