Common use of Use of the Services Clause in Contracts

Use of the Services. 1.1 We will make the Oracle services listed in Your order (the “Services”) available to You pursuant to this Agreement and Your order. Except as otherwise stated in this Agreement or Your order, You have the non- exclusive, worldwide, limited right to use the Services during the period defined in Your order, unless earlier terminated in accordance with this Agreement or Your order (the “Services Period”), solely for Your internal business operations. You may allow Your Users (as defined below) to use the Services for this purpose, and You are responsible for their compliance with this Agreement and Your order. 1.2 The Service Specifications describe and govern the Services. During the Services Period, we may update the Services and Service Specifications (with the exception of the Data Processing Agreement as described below) to reflect changes in, among other things, laws, regulations, rules, technology, industry practices, patterns of system use, and availability of Third Party Content (as defined below). Oracle updates to the Services or Service Specifications will not materially reduce the level of performance, functionality, security or availability of the Services during the Services Period of Your order. 1.3 You may not, and may not cause or permit others to: (a) use the Services to harass any person; cause damage or injury to any person or property; publish any material that is false, defamatory, harassing or obscene; violate privacy rights; promote bigotry, racism, hatred or harm; send unsolicited bulk e-mail, junk mail, spam or chain letters; infringe property rights; or otherwise violate applicable laws, ordinances or regulations; (b) perform or disclose any benchmarking or availability testing of the Services; (c) perform or disclose any performance or vulnerability testing of the Services without Oracle’s prior written approval, or perform or disclose network discovery, port and service identification, vulnerability scanning, password cracking or remote access testing of the Services; or (d) use the Services to perform cyber currency or crypto currency mining ((a) through (d) collectively, the “Acceptable Use Policy”). In addition to other rights that we have in this Agreement and Your order, we have the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing or disabling access to material that violates the policy.

In addition to other rights that we have in this Agreement and Your order, we have the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing or disabling access to material that violates the policy.

During the Services Period, we Oracle may update the Services and Service Specifications (with the exception of the Data Processing Agreement as described below) to reflect changes in, among other things, laws, regulations, rules, technology, industry practices, patterns of system use, and availability of Third Party Content (as defined below)Content. Oracle updates to the Services or Service Specifications will not materially reduce the level of performance, functionality, security or availability of the Services during the Services Period of Your order. 1.3 1.3. You may not, and may not cause or permit others to: (a) use the Services to harass any person; cause damage or injury to any person or property; publish any material that is false, defamatory, harassing or obscene; violate privacy rights; promote bigotry, racism, hatred or harm; send unsolicited bulk e-mail, junk mail, spam or chain letters; infringe property rights; or otherwise violate applicable laws, ordinances or regulations; (b) perform or disclose any benchmarking benchmarking, availability or availability performance testing of the Services; or (c) perform or disclose any performance or vulnerability testing of the Services without Oracle’s prior written approval, or perform or disclose network discovery, port and service identification, vulnerability scanning, password cracking or cracking, remote access testing or penetration tests of the Services; or Services (d) use the Services to perform cyber currency or crypto currency mining ((a) through (d) collectively, the “Acceptable Use Policy”). In addition to other rights that we have in this Agreement and Your order, we have the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing or disabling access to material that violates the policy. 1.4. Notwithstanding anything to the contrary in this Agreement and Your Order, You acknowledge and agree that: (a) Oracle China will subcontract performance of the Remote Software Services to Oracle Offshore and/or its subcontractors; (b) the Services Environment will be located, and the Remote Software Services will be performed, outside the People’s Republic of China; (c) Oracle China is solely a reseller of the Remote Software Services; (d) access to the Remote Software Services by You and Your Users is conditional upon Your and Your Users’ agreement to any terms and conditions concerning access that Oracle Offshore may stipulate from time to time.

Use of the Services. 1.1 1.1. Except as otherwise stated in this Agreement or Your orderClient Order, You Client shall have the non- non-exclusive, worldwide, limited right to use the Services during the period defined in Your orderClient Order, unless earlier terminated in accordance with this Agreement or Your order Client Order (the “Services PeriodTerm”), solely for Your Client internal business operations. You Client may allow Your Client Users (as defined below) to use the Services for this purpose, and You Client are responsible for their compliance with this Agreement and Your orderClient Order. 1.2 The Service Specifications describe and govern services description in each Order governs the Services. During the Services PeriodTerm, we may update the Services and Service Specifications (with the exception of the Data Processing Agreement as described below) to reflect changes in, among other things, laws, regulations, rules, technology, industry practices, patterns of system use, and availability of Third Third-Party Services and Content (as defined below). Oracle CapTech's updates to the Services or Service Specifications will not materially reduce the level of performance, functionality, security or availability of the Services during the Services Period of Your orderClient Order. 1.3 You Client may not, and may not cause or permit others to: (a) use the Services to harass any person; cause damage or injury to any person or property; publish any material that is false, defamatory, harassing or obscene; violate privacy rights; promote bigotry, racism, hatred or harm; send unsolicited bulk e-mail, junk mail, spam or chain letters; infringe property Intellectual Property rights; or otherwise violate applicable laws, ordinances or regulations; (b) perform or disclose any benchmarking or availability testing of the Services; or (c) perform or disclose any performance or vulnerability testing of the Services without OracleCapTech’s prior written approval, or perform or disclose network discovery, port and service identification, vulnerability scanning, password cracking or remote access testing of the Services; or (d) use the Services to perform cyber currency or crypto currency mining ((a) through (dc) collectively, the “Acceptable Use Policy”). In addition to other rights that we have in this Agreement and Your orderClient Order, we have the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing or disabling access to material that violates the policy. 1.4 The Services will be made available using a thirty-party platform provided by Amazon Web Services ("AWS" or the "AWS Platform"). By entering this Agreement, Client acknowledges that in addition to the terms and conditions of this Agreement, its use of the AWS Service Offerings is subject to the AWS Customer Agreement, a separate agreement between Client and Amazon Web Services, Inc., a current version of which is located at AWS Customer Agreement and the AWS Platform is provided under the following terms AWS Service Terms . AWS Site Terms , AWS Acceptable Use Policy and AWS Privacy Notice. 1.5 The Services will utilize Google Play for the purposes of refining data accuracy. By entering this Agreement, Client acknowledges that in addition to the terms and conditions of this Agreement, its use of the Google is subject to the Google Play Terms of Service

In addition to other rights that we have in this Agreement and Your order, we have the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing or disabling access to material that violates the policy.

You may allow Your Users (as defined below) to use the Services for this purpose, and You are responsible for their compliance with this Master Agreement and Your order. 1.2 The Service Specifications describe and govern the Services. During the Services Period, we Oracle may update the Services and Service Specifications (with the exception of the Data Processing Agreement as described below) to reflect changes in, among other things, laws, regulations, rules, technology, industry practices, patterns of system use, and availability of Third Party Content (as defined below)Content. Use of the Services. 1.1 We You have purchased TEAM Cloud and/or, if applicable, other cloud services from the Service Provider, and the Service Provider will make the Oracle services listed in Your order with the Service Provider (the “Services”) available to You pursuant to this Agreement and Your order. Except as otherwise stated in this Agreement or Your order, You have the non- non-exclusive, worldwide, limited right to use the Services during the period defined in Your order, unless earlier terminated in accordance with this Agreement or Your order (the “Services Period”), solely for Your internal business operations. You may allow Your Users (as defined below) to use the Services for this purpose, and You are responsible for their compliance with this Agreement and Your order. 1.2 The Service Specifications describe and govern the Services. During the Services Period, we the Service Provider may update the Services and Service Specifications (with the exception of the Data Processing Agreement as described below) to reflect changes in, among other things, laws, regulations, rules, technology, industry practices, patterns of system use, and availability of Third Third-Party Content (as defined below).
