Use of the Services. The Services are for personal, residential, non-commercial use only, unless otherwise specifically authorized by us in writing. We prohibit the following activities: • Reselling the Services in whole or in part; • Using the Services, directly or indirectly, for any unlawful purpose or in violation of any applicable policy that we make available to you; • Using the Services to transmit, communicate, or store any information, data, or material in violation of any law, rule, or regulation; • Tampering with, making any unauthorized connection to, or modifying any part of our cable network or the Services for any purpose; • Attaching any unauthorized device to our cable network or the Services; or • Attaching anything to the Inside Wiring, the Xfinity Equipment, or Customer Equipment that impairs the integrity of our cable network, that degrades our cable network’s signal quality or strength, or that creates signal leakage. You agree not to engage in these or other similar prohibited activities, or help anyone else do so. You acknowledge that you are accepting this Agreement on behalf of all persons who use the Services at your Premises (or any other locations authorized by us). You are solely responsible for ensuring that all other users of the Services understand and comply with this Agreement and any applicable policies. You are liable for all authorized and unauthorized use of the Services. If the Xfinity Equipment has been stolen or the Services have been used without your authorization or in violation of this Agreement, you agree to notify us immediately in writing, or by calling ▇-▇▇▇-▇▇▇▇▇▇▇ during normal business hours. If you violate this Agreement, or if you fail to notify us of unauthorized use in a timely manner, we may terminate the Services and recover damages. Since it would be difficult, if not impossible, to precisely calculate our lost revenue from unauthorized Services or tampering, you agree to pay $500.00 per device used to receive unauthorized Services as liquidated damages. These liquidated damages are in addition to our cost to replace any altered, damaged, or unreturned Xfinity Equipment, or other equipment owned by us, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment, and we reserve the right to report any illegal activities to law enforcement. In connection with your use of the Services, if you need to access third-party software or hardware, you will be subject to third-party terms and conditions. Use of the Services. The (a) By connecting the Services are for personalto the internet, residential, non-commercial use only, unless otherwise specifically authorized by us in writingthere is a risk that viruses or other malware may be transferred to your Customer Premise Equipment. We prohibit cannot provide any guarantees that such software will not damage your Customer Premise Equipment or your data. We will not keep any back-up copies of data belonging to you that you have transmitted or received using the following activities: • Reselling Services. We accept no liability for damage caused to your Customer Premise Equipment or your data or any other damages or losses arising from the Services in whole intentional or in part; • Using unintentional downloading or transmission of software including viruses using the Services. (b) As a user of the Services, directly you accept that we do not control, endorse or indirectlycensor the material made available over the internet. You accept that third party material could be illegal, for misleading, offensive or deceptive. You use it at your own risk and subject to all applicable national and international laws and regulations. (c) We do not permit you to cause nuisance or inconvenience to us or to other users in any unlawful purpose way using the Services. This includes hacking, network sniffing or in violation similar techniques, sending unsolicited messages without reasonable cause, by spamming or using anonymous remailers, different servers, or other means. If you send any such messages through the Service, you may be liable to criminal or civil action and we may suspend or disconnect some or all ofthe Services and such action on our part may give rise to legitimate early Termination of this Agreement and accelerated Charges being payable by you. (d) You agree that if we stop providing the Service to you, you will return our Equipment to us at your cost within 14 days and dispose of any applicable policy parts of the Equipment that we make available tell you not to you; • Using return. See Section 5. (e) The Service Provider may from time to time restrict or suspend applications that they consider have a significant negative effect on their network. These include but are not limited to peer to peer applications and any otherprotocol liable to have a significant or disproportionately deleterious impact on the overall quality of the Services as experienced across all customers within any beam. (f) Due to Latency, certain applications (eg. online gaming) are not recommended. It is your responsibility to establish the suitability of the Wireless Broadband Service for your requirements. If you proceed to Order Equipment or Services for use with any application that we do not recommend, the failure of the Services to transmitsupport such an application will not constitute a right to cancel and the Minimum Period will remain valid. (g) We reserve the right to charge you for technical support if we reasonably consider that our support is not primarily supporting the functionality of the Services but the interoperability with Customer Equipment or other 3rd party applications, communicatesoftware or hardware. (h) We offer both consumer and business Packages. Consumer Packages are primarily designed and priced for the use of single family, home use. If in our reasonable opinion you are using a consumer Package primarily for business use, we have the right to offer you an appropriate business Package. If you do not wish to transfer to the offered Package, we have the right to terminate this Agreement upon 30 days notice. We will not apply any Charges after the termination date but you are responsible at your cost for removing our Equipment and returning it safely to us. (i) We make our Services available to you and supply to you the Equipment on the conditions that : a. They are not used for anything illegal and they are not used to offend or create nuisance; b. Only the Equipment or other items supplied by us to use with the Equipment is used to access the Services; c. You follow our reasonable instructions in relation to the Installation, Services, Equipment and Charges; d. You do not re-sell, exchange, rent, hire, or store permit access to the Services or the Equipment to anyone else or grant any informationcharges, dataliens or other rights, powers or material in violation of interests over; e. You do not, nor permit any law, rule, or regulation; • Tampering with, making any unauthorized connection third party to, to maintain or modifying any part of our cable network repair or attempt to maintain or repair the software providing the Services or the Services for Equipment, without our prior written consent. Any such action will void any purpose; • Attaching any unauthorized device to our cable network or the Services; or • Attaching anything warranties relating to the Inside Wiring, the Xfinity Equipment, software or Customer Equipment that impairs has been affected; f. You do not use the integrity of our cable network, Wireless Broadband Service to send or receive any material that degrades our cable networkbreaches another person’s signal quality or strength, or that creates signal leakage. You agree not to engage in these copyright or other similar prohibited activitiesintellectual property rights, or help anyone else do so. You acknowledge that you are accepting this Agreement on behalf of all persons who use the Services at your Premises (or any other locations authorized material that is illegal, obscene, indecent, fraudulent, libellous, harassing or that you do not have the right to transmit under any applicable law where you are using the Services; g. You do not use the Wireless Broadband Service to transmit knowingly or recklessly any material that contains viruses or any computer code, files or programs designed to interrupt, damage, destroy or limit the operation of any computer software, hardware or telecomsequipment; h. You do not interrupt damage or impair any website or the Wireless Broadband Service in any way; i. You or your employees/users do not hack into or attempt to hack into our or any third party systems or try to get round any security safeguards. (j) You acknowledge and agree that if you (or your employees or other authorised users, where applicable) break or cause a breach of any of the conditions set out in this Section 0, that you have broken an important condition of this Agreement and we shall have the right to end this Agreement under clause 10 and you hereby indemnify and agree to keep us indemnified in respect of any breach by us). You are solely responsible for ensuring that all you, your employees, or other users of the Services understand and comply with this Agreement and any applicable policies. Use of the Services. The Services 6.1. You are responsible for personalidentifying and authenticating all Users, residential, non-commercial use only, unless otherwise specifically authorized for approving access by us in writing. We prohibit the following activities: • Reselling the Services in whole or in part; • Using such Users to the Services, directly for controlling against unauthorized access by Users, and for maintaining the confidentiality of usernames, passwords and account information. By federating or indirectlyotherwise associating Your and Your Users’ usernames, passwords and accounts with ProActive, You accept responsibility for the timely and proper termination of user records in Your local (intranet) identity infrastructure or on Your local computers. ProActive is not responsible for any unlawful purpose harm caused by Your Users, including individuals who were not authorized to have access to the Services but who were able to gain access because usernames, passwords or accounts were not terminated on a timely bass in violation Your local identity management infrastructure or Your local computers. You are responsible for all activities that occur under Your and Your Users’ usernames, passwords or accounts or as a result of Your Users’ access to the Services, and agree to notify ProActive immediately of any applicable policy that we make available to you; • Using the Services to transmit, communicate, or store any information, data, or material in violation of any law, rule, or regulation; • Tampering with, making any unauthorized connection to, or modifying any part of our cable network or the Services for any purpose; • Attaching any unauthorized device to our cable network or the Services; or • Attaching anything to the Inside Wiring, the Xfinity Equipment, or Customer Equipment that impairs the integrity of our cable network, that degrades our cable network’s signal quality or strength, or that creates signal leakageuse. 6.2. You agree not to engage in these use or other similar prohibited activities, or help anyone else do so. In connection with your permit use of the Services, including by uploading, emailing, posting, publishing or otherwise transmitting any material, including Your Content, Your Applications and Third Party Content, for any purpose that may (a) menace or harass any person or cause damage or injury to any person or property, (b) involve the publication or any material that is false, defamatory, harassing or obscene, (c) violate privacy rights or promote bigotry, racism, hatred or harm, (d) constitute unsolicited bulk e-mail, “junk mail”, “spam” or chain letters; (e) constitute an infringement of intellectual property, other proprietary rights, software licensing and usage rights, or (f) otherwise violate applicable laws, ordinances or regulations. In addition to any other rights afforded to ProActive under this Agreement, ProActive reserves the right, but has no obligation, to take remedial action if you need any material violates the foregoing restrictions, including the removal or disablement of access to access third-party software or hardwaresuch material. ProActive shall have no liability to You in the event that ProActive takes such action. You shall have sole responsibility for the accuracy, you will be subject quality, integrity, legality, reliability, appropriateness and ownership of all of Your Content and Your Applications. You agree to third-party terms defend and conditionsindemnify ProActive against any claim arising out of a violation of Your obligations under this section. 6.3. Certain components You are required to accept all patches, bug fixes, updates, maintenance and service packs (collectively, “Patches”) necessary for the proper function and security of the Services are also subject to our Software License in accordance with Exhibit C of this Agreement. Except for emergency or security related maintenance activities, ProActive will coordinate with You the scheduling of application of Patches, where possible, based on ProActive’s next available at ▇▇▇▇▇▇▇standard maintenance window.▇▇▇/▇▇▇▇▇/▇▇▇▇▇▇▇. If you do not wish to transfer to the offered Package, we have the right to terminate this Agreement upon 30 days notice. We will not apply any Charges after the termination date but you are responsible at your cost for removing our Equipment and returning it safely to us. (i) We make our Services available to you and supply to you the Equipment on the conditions that : a. They are not used for anything illegal and they are not used to offendor create nuisance; b. Only the Equipment or other items supplied by us to use with the Equipment is used to access the Services; c. You follow our reasonable instructions in relation to the Installation, Services, Equipment and Charges; d. You do not re-sell, exchange, rent, hire, or store permit access to the Servicesor the Equipment to anyone else or grant any informationcharges, dataliens or other rights, powers or material in violation of interests over; e. You do not, nor permit any law, rule, or regulation; • Tampering with, making any unauthorized connection third party to, to maintain or modifying any part of our cable network repair orattempt to maintain or repair the software providing the Services or the Services for Equipment, without our prior written consent. Any such action will void any purpose; • Attaching any unauthorized device to our cable network or the Services; or • Attaching anything warranties relating to the Inside Wiring, the Xfinity Equipment, software or Customer Equipment that impairs has been affected; f. You do not use the integrity of our cable network, Wireless Broadband Service to send or receive any material that degrades our cable networkbreaches another person’s signal quality or strength, or that creates signal leakage. You agree not to engage in these copyright or other similar prohibited activitiesintellectual property rights, or help anyone else do so. You acknowledge that you are accepting this Agreement on behalf of all persons who use the Services at your Premises (or any other locations authorized material that is illegal, obscene, indecent, fraudulent, libellous, harassing or that you do not have the right to transmit under any applicable law where you are using the Services; g. You do not use the Wireless Broadband Service to transmit knowingly or recklessly any material that contains viruses or any computer code, files or programs designed to interrupt, damage, destroy or limit the operation of any computer software, hardware or telecomsequipment; h. You do not interrupt damage or impair any website or the Wireless Broadband Service in any way; i. You or your employees/users do not hack into or attempt to hack into our or any third party systems or try to get round any security safeguards. (j) You acknowledge and agree that if you (or your employees or other authorised users, where applicable) break or cause a breach of any of the conditions set out in this Section 0, that you have broken an important condition of this Agreement and we shall have the right to end this Agreement under clause 10 and you hereby indemnify and agree to keep us indemnified in respect of any breach by us). You are solely responsible for ensuring that all you, your employees, or other users of the Services understand and comply with this Agreement and any applicable policies. You are liable for all authorized and unauthorized use Equipment supplied to you, of the Services. If the Xfinity Equipment has been stolen or the Services have been used without your authorization or in violation terms of this Agreement, you agree to notify us immediately in writing, or by calling ▇-▇▇▇-▇▇▇▇▇▇▇ during normal business hours. (b) As a user of the Services, directly you accept that we do not control, endorse or indirectlycensor the material made available over the internet. You accept that third party material could be illegal, for misleading, offensive or deceptive. You use it at your own risk and subject to all applicable national and international laws and regulations. (c) We do not permit you to cause nuisance or inconvenience to us or to other users in any unlawful purpose way using the Services. This includes hacking, network sniffing or in violation similar techniques, sending unsolicited messages without reasonable cause, by spamming or using anonymous remailers, different servers, or other means. If you send any such messages through the Service, you may be liable to criminal or civil action and we may suspend or disconnect some or all of the Services and such action on our part may give rise to legitimate early Termination of this Agreement and accelerated Charges being payable by you. (d) You agree that if we stop providing the Service to you, you will return our Equipment to us at your cost within 14 days and dispose of any applicable policy parts of the Equipment that we make available tell you not to you; • Using return. See Section 5. (e) The Service Provider may from time to time restrict or suspend applications that they consider have a significant negative effect on their network. These include but are not limited to peer to peer applications and any other protocol liable to have a significant or disproportionately deleterious impact on the overall quality of the Services as experienced across all customers within any beam. (f) Due to Latency, certain applications (eg. online gaming) are not recommended. It is your responsibility to establish the suitability of the Wireless Broadband Service for your requirements. If you proceed to Order Equipment or Services for use with any application that we do not recommend, the failure of the Services to transmitsupport such an application will not constitute a right to cancel and the Minimum Period will remain valid. (g) We reserve the right to charge you for technical support if we reasonably consider that our support is not primarily supporting the functionality of the Services but the interoperability with Customer Equipment or other 3rd party applications, communicatesoftware or hardware. (h) We offer both consumer and business Packages. Consumer Packages are primarily designed and priced for the use of single family, home use. If in our reasonable opinion you are using a consumer Package primarily for business use, we have the right to offer you an appropriate business Package. Use of the Services. The Services 6.1 You are responsible for personalidentifying and authenticating all Users, residential, non-commercial use only, unless otherwise specifically authorized for approving access by us in writing. We prohibit the following activities: • Reselling the Services in whole or in part; • Using such Users to the Services, directly for controlling against unauthorized access by Users, and for maintaining the confidentiality of usernames, passwords and account information. You accept responsibility for the confidentiality and timely and proper termination of User records in Your local (intranet) identity infrastructure or indirectly, on Your local computers. Hoplon Solutions is not responsible for any unlawful purpose harm caused by Your Users, including individuals who were not authorized to have access to the Services but who were able to gain access because usernames, passwords or accounts were not terminated on a timely basis in violation Your local identity management infrastructure or Your local computers. You are responsible for all activities that occur under Your and Your Users’ usernames, passwords or accounts or as a result of Your or Your Users’ access to the Services, and agree to notify Hoplon Solutions immediately of any applicable policy that we unauthorized use. Hoplon Solutions shall have no liability to You in the event that impairs Hoplon Solutions takes such action. You shall have sole responsibility for the integrity accuracy, quality, integrity, legality, appropriateness and ownership of our cable network, that degrades our cable network’s signal quality or strength, or that creates signal leakageall of Your Content. You agree not to engage in these or other similar prohibited activities, or help anyone else do so. You acknowledge that you are accepting this Agreement on behalf defend and indemnify Hoplon Solutions against any claim arising out of all persons who use the Services at your Premises (or any other locations authorized by us). If the Xfinity Equipment has been stolen or the Services have been used without your authorization or in a violation of Your obligations under this Agreement, you agree to notify us immediately in writing, or by calling ▇-▇▇▇-▇▇▇▇▇▇▇ during normal business hours. If you violate this Agreement, or if you fail to notify us of unauthorized use in a timely manner, we may terminate the Services and recover damages. Since it would be difficult, if not impossible, to precisely calculate our lost revenue from unauthorized Services or tampering, you agree to pay $500.00 per device used to receive unauthorized Services as liquidated damages. These liquidated damages are in addition to our cost to replace any altered, damaged, or unreturned Xfinity Equipment, or other equipment owned by us, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment, and we reserve the right to report any illegal activities to law enforcement. In connection with your use of the Services, if you need to access third-party software or hardware, you will be subject to third-party terms and conditions. Certain components of the Services are also subject to our Software License Agreement, available at ▇▇▇▇▇▇▇Section.▇▇▇/▇▇▇▇▇/▇▇▇▇▇▇▇. Use of the Services. The Services are for personal, residential, non-commercial use only, unless otherwise specifically authorized by us in writing. We prohibit the following activities: • Reselling the Services in whole or in part; • Using the Services, directly or indirectly, for any unlawful purpose or in violation of any applicable policy that we make available to you; • Using the Services to transmit, communicate, or store any information, data, or material in violation of any law, rule, or regulation; • Tampering with, making any unauthorized connection to, or modifying any part of our cable network or the Services for any purpose; • Attaching any unauthorized device to our cable network or the Services; or • Attaching anything to the Inside Wiring, the Xfinity Equipment, or Customer Equipment that impairs the integrity of our cable network, that degrades our cable network’s signal quality or strength, or that creates signal leakage. You agree not to engage in these or other similar prohibited activities, or help anyone else do so. You acknowledge that you are accepting this Agreement on behalf of all persons who use the Services at your Premises (or any other locations authorized by us). You are solely responsible for ensuring that all other users of the Services understand and comply with this Agreement and any applicable policies. You are liable for all authorized and unauthorized use of the Services.
