Common use of Use of the Works Clause in Contracts

Use of the Works. before Completion has been certified  The Employer uses the parts of the Works before Completion is certified by the Project Manager which constitutes Take over by the Employer.  Any (“hand over”) inspections done to allow use of commissioned portions of the Works are done to aid prompt correction of Defects and should not be confused with Take over procedures.
