Common use of Use of Third Party Information Clause in Contracts

Use of Third Party Information. Involve complies with all applicable United States, and to the best of its knowledge (without duty of inquiry), foreign privacy laws and regulations regarding the collection, retention, use and disclosure of personal information, and Involve takes all appropriate and industry standard measures to protect and maintain the confidential nature of the personal information provided to Involve by individuals. Involve has reasonable, industry standard technological and procedural measures in place to protect personal information collected from individuals against loss, theft and unauthorized access or disclosure. Involve does not knowingly collect information from or target children under the age of thirteen. Involve does not sell, rent or otherwise make available to third parties any personal information submitted by individuals. Involve has the full power and authority to use and to transfer all rights Involve has in any third party's personal information in Involve's possession and/or control to Kintera and Merger Sub. Involve is not a party to any contract, nor is it subject to any other obligation that, following the Closing, would prevent Kintera and Merger Sub and/or the affiliates of Kintera from using such information in a manner consistent with applicable privacy laws, customer privacy policies and industry standards regarding the disclosure and use of information.
