Use, Safety and Utility. Computer-aided design software and other technical software applications are tools intended to be used by qualified individuals. They are not substitutes for professional judgment. They are intended to assist with product design and are not substitutes for independent testing of product stress, safety, reliability, and suitability for specific tasks. Due to the large variety of its potential applications, the Software has not been tested in all situations under which it may be used. Micro Logic Corp. shall not be liable in any manner whatsoever for the results obtained through the use of the Software. MICRO LOGIC CORP. DOES NOT WARRANT THAT THE FUNCTIONS OF THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE. YOU ARE SOLELY RESPONSIBLE FOR THE DETERMINATION OF APPROPRIATE USES FOR THE SOFTWARE AND THE SELECTION OF THE SOFTWARE AS APPROPRIATE TO ACHIEVE INTENDED RESULTS. YOU ARE ALSO SOLELY RESPONSIBLE FOR ESTABLISHING THE ADEQUACY OF INDEPENDENT PROCEDURES FOR TESTING THE RELIABILITY AND ACCURACY OF ANY PROGRAM OUTPUT, INCLUDING ALL ITEMS DESIGNED BY USING THE SOFTWARE. You acknowledge that the Custom Parts designed with the Software and ordered from ▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇ were not designed by Micro Logic Corp., nor does Micro Logic Corp. have any control over their design, or their use or misuse once they have been delivered to You. It is Your responsibility to create a safe design and provide proper safety devices and equipment to safeguard the operator and nearby persons from harm for any particular use, operation, or setup, and to adequately conform to all Federal, State, and Local government legal and safety standards, and all industry safety standards. Additionally it is Your responsibility to fully inspect all received parts for design conformity, variation in material selection, defects in fabrication, defects in material uniformity or strength, and all other matters that could affect safety.

  • Fire Safety Resident will not tamper with fire alarms, smoke detectors, fire extinguishers, fire hoses, or exit signs. Resident will promptly evacuate Residence Facility upon the sounding of an alarm or as otherwise directed by College Housing staff. Resident will participate in any periodic fire drill and fire safety training conducted by College for the Residence Facility.

  • Health and Safety Standards Contractor shall abide by all health and safety standards set forth by the State of California and/or the County of ▇▇▇▇▇▇ pursuant to the Injury and Illness Prevention Program. If applicable, Contractor must receive all health and safety information and training from County.

  • WORKPLACE SAFETY AND INSURANCE 41.1 Where an employee is absent by reason of an injury or an occupational disease for which a claim is made under the Workplace Safety and Insurance Act, his or her salary shall continue to be paid for a period not exceeding thirty (30) days. If an award is not made, any payments made under the foregoing provisions in excess of that to which he or she is entitled under Articles 44.1 and 44.6 (Short Term Sickness Plan) shall be an amount owing by the employee to the Employer. 41.2 Where an employee is absent by reason of an injury or an occupational disease for which an award is made under the Workplace Safety and Insurance Act, his or her salary shall continue to be paid for a period not exceeding three (3) consecutive months or a total of sixty-five (65) working days where such absences are intermittent, following the date of the first absence because of the injury or occupational disease, and any absence in respect of the injury or occupational disease shall not be charged against his or her credits. 41.3 Where an award is made under the Workplace Safety and Insurance Act to an employee that is less than the regular salary of the employee and the award applies for longer than the period set out in Article 41.2 and the employee has accumulated credits, his or her regular salary may be paid and the difference between the regular salary paid after the period set out in Article 41.2 and the compensation awarded shall be converted to its equivalent time and deducted from his or her accumulated credits. 41.4 Where an employee receives an award under the Workplace Safety and Insurance Act, and the award applies for longer than the period set out in Article 41.2 (i.e. three (3) months), the Employer will continue subsidies for Basic Life, Long Term Income Protection, Supplementary Health and Hospital and the Dental Plans for the period during which the employee is receiving the award. The Employer shall continue to make the Employer’s pension contributions unless the employee gives the Employer a written notice that the employee does not intend to pay the employee’s pension contributions. 41.5 Where an employee is absent by reason of an injury or an occupational disease for which an award is made under the Workplace Safety and Insurance Act, the employee shall not be entitled to a leave of absence with pay under Article 44 (Short Term Sickness Plan) as an option following the expiry of the application of Article 41.2.

  • Rectification of Safety Hazard (a) Where, because of the existence of a safety hazard, a site has been stopped for a defined period of time and Employees sent off site by agreement between Site Managers and any combination of Union Official/s, Health and Safety Committee, those people who remain on site to do rectification work will be paid at the rate of double time for all such work. (b) This would not be applicable on normal de watering (see clause 32.6 hereof) or normal housekeeping work or where a section of the site has been declared unsafe and normal rectification occurs whilst the remainder of the site carries on working. It is agreed that any ‘housekeeping’ work performed on Projects is to be paid at single time rate.
