User's Covenants. User covenants that from the Execution Date of a Site Agreement, that the Facilities, and all installation, operation, modification, relocation and maintenance associated therewith, will:
(a) In no way damage BellSouth's Tower, Property, any other structure or accessories thereto, any Prior User's, as defined below, equipment or facilities or any Subsequent User's, as defined below, equipment or facilities, normal wear and tear excepted. If damage, other than normal wear and tear, occurs and such damage is caused by User, or User's employees, agents, contractors, or subcontractors, then User shall be liable for repair or reimbursement of repair for said damages;
(b) Not interfere with BellSouth's operation on the Tower or the operations of any Prior User (as defined herein). For purposes hereof, a "Prior User" shall mean any other user of the Tower that has submitted to BellSouth a site application in good faith prior to the submission of User's Site Application for such Tower, which site application serves as the basis for a written agreement for the use of the Tower by such user. In the event BellSouth determines, in its sole discretion based on standard and accepted engineering practices, that User's Facilities are interfering with the operation of BellSouth's or a Prior User's equipment, authorized frequency spectrum or signal strength, upon the request of User, BellSouth shall provide User with a copy of the report. User shall, within forty-eight (48) hours of notification, take all steps necessary to eliminate the interference, with the exception of ceasing User's operations. If User cannot eliminate or resolve such interference within the forty-eight (48) hour period, BellSouth shall have the right to require that User turn off its Facilities and only turn on its Facilities during off-peak hours specified by BellSouth in order to test whether such interference continues or it has been satisfactorily eliminated. In the event that User is unable to resolve or eliminate, to the satisfaction of BellSouth, such interference within thirty (30) days from the initial notification of such interference, User will immediately remove or cease operations of the objectionable Facilities and BellSouth shall have the right to terminate the applicable Site Agreement. User shall not on any Site interfere with BellSouth's use of the Site, the provision of services to BellSouth's customers, or the use of the Site by other Prior Users. User's Covenants. 7.1 The User covenants and agrees with the Authority as follows:
a) The User shall use the Access Area in a manner that ensures that the Access Area and the Lands remain in a clean and tidy condition. If the User or persons for whom the User is responsible in law breach this provision, in addition to the other remedies of the Authority, the User shall restore the Access Area and the Lands to a clean and tidy condition. Alternatively, the Authority may in its sole discretion undertake the required maintenance, cleaning, janitorial services, repairs or restoration of the Access Area or the Lands, as the case may be, and the cost of such maintenance, cleaning, janitorial services, repairs or restoration shall, in addition to the other remedies of the Authority, be payable by the User to the Authority forthwith upon demand;
b) Not to commit any waste or create any nuisance or damage on the Access Area or Lands or to lands and/or communities adjacent to the Lands. Notwithstanding Section 3 of this Agreement, the User shall not use the Access Area or Lands for any purpose which the Authority deems to be a nuisance to or an interference with any existing use of the Lands, including the Access Area, or to lands and/or communities adjacent to the Lands as the Authority may determine from time to time in its sole discretion;
c) Not to construct, erect, leave or place any structures, signage, equipment, machinery or other improvements on or make any alterations or renovations to the Access Area, without the prior written consent of the Authority, which consent may be withheld for any reason, and upon such terms and conditions as the Authority may require;
d) To pay all costs and expenses arising out of the User’s use of the Access Area whether pursuant to this Agreement including, but not limited to, utilities, equipment and Au hor ersonne . Payment of additional ts d exp nses shall be ma by the User directly to the invoici g depar ment o the Autho ity, mediately u eceipt of an invoice;
e) Not to bring any claims or demands of any nature or kind in respect of loss, injury or damage to the User's property, business, employees, Sponsored Owner Operators, contractors or otherwise howsoever against the Authority;
f) To accept full responsibility, risk for and control over all drivers of the User, whether employees or contractors including, without limitation, Sponsored Owner Operators;

(a) to pay all amounts payable by User to Master Tenant under this Agreement (collectively the "License Fees");
(b) to observe and perform all the covenants and obligations of User herein;
(c) to use the Licensed Premises only for the use stated on page one of this Agreement;
(d) to comply with present and future laws, regulations and orders relating to the occupation or use of the Licensed Premises;
(e) not to do, omit to do or permit to be done anything which will cause or shall have the effect of causing the cost of the Master Tenant’s insurance in respect of the Licensed Premises to be increased, or any policy of insurance on or relating to the Licensed Premises to be subject to cancellation;
(f) to permit Master ▇▇▇▇▇▇ to assign a designated representative to supervise the use of the facility and any equipment supplied by the Master Tenant for the User’s use.
(g) shall conserve heat, water and electricity and shall use due care in the use of the Licensed Premises and the Building and shall not neglect or misuse any of the fixtures, equipment or apparatus;
(h) to maintain the Licensed Premises and the Building and all improvements therein in good order and condition;
(i) to adequately supervise all of User’s employees, agents, guests and invitees to the Licensed Premises and Building;
(j) to follow all reasonable rules, regulations and procedures put in place by Master Tenant (including security procedures) with respect to the Licensed Premises and Building;
(k) not to create (by act or omission) or permit to exist any condition at or about the Licensed Premises or the Building which results in a risk to the personal health or safety of any person or damage to property;
(l) not to use or store on or near the Building or Licensed Premises any flammable or explosive substance;
(m) not to interfere in the Master ▇▇▇▇▇▇’s operation of the Building;
(n) to leave the Licensed Premises in broom-clean condition following each use by User or its employees, agents, guests and invitees; and
(o) to notify Master Tenant immediately of any damage to the Licensed Premises, Building, or any other of Master Tenant’s property, and to notify Master Tenant immediately of any conditions in the Building or Licensed Premises that are dangerous to human health or safety, or which may damage the Building or Licensed Premises.

User will not use the Leased Space in any way which will affect the existing rates for, or cause the cancellation of, any insurance policy of Lamplighters, and will not commit any waste on the Leased Space or the Premises, permit any nuisance as defined in California Civil Code Section 3479, use the Leased Space or the Premises for any unlawful purpose, alter or modify the Leased Space in any way, or discharge, release or leave upon the Leased Space or the Premises any hazardous or toxic materials, wastes, or substances as those terms are defined in any federal, state or local laws, ordinances, regulations, codes or rules. User shall comply with all statutes, ordinances, regulations, and requirements of any and all governmental entities, and keep the Leased Space and the Premises part free and clear from and against any and all liens.
