USING THE SOFTWARE Clause Samples

The "Using the Software" clause defines the terms and conditions under which a user is permitted to access and operate the licensed software. Typically, it outlines acceptable uses, restrictions on modification or distribution, and may specify the number of devices or users allowed. This clause ensures that users understand their rights and limitations, helping to prevent unauthorized use and protect the intellectual property of the software provider.
USING THE SOFTWARE. You will require a Dongle in order to use the Software, which we will provide to you as part of the Equipment. The Dongle will initially enable you to access the Software during the Initial Term. For each subsequent 12 month period in the Term, we will need to reactivate the Dongle and may provide you with an initial 3 month period of access which will be extended to 12 months once we have received the Services Fees for that period from you.
USING THE SOFTWARE and the Tools in the course of its normal business to the extent that this use does not result in a disclosure of the Customer’s Confidential Information or Customer Data; and
USING THE SOFTWARE. 3.1. In the case of a stand-alone installation you may not install the SERVER SOFTWARE on any other computers except a single installation on a company's server computer or your home computer. 3.2. You may install and use the CLIENT SOFTWARE simultaneously on a limited number of computers at the same time. The number of CLIENT SOFTWARE that supported by the SERVER SOFTWARE is provided to you by a LICENSE KEY file.
USING THE SOFTWARE. 4.1 In order to use the Software you must have a Steam account. If you don’t already have one, creating one is free from ▇▇▇▇://▇▇▇▇▇.▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇/ and setting it up involves creating a username and password – which you should keep secure and confidential (i.e. don't give it to anyone else). You must not allow anyone else to access your account. 4.2 Please note that the Software is intended strictly for leisure purposes only. It is not designed for, and must not be used, for any training or in any way as a realistic simulation. We accept no responsibility or liability for any failure by users to comply with this clause 4.2.
USING THE SOFTWARE. IT PROVIDES A LICENSE TO USE THE SOFTWARE AND CONT AINS WARRANTY INFORMATION AND LIABILITY DISCLAIMERS. BY INSTALLING AND USING TH E SOFTWARE, YOU ARE CONFIRMING YOUR ACCEPTANCE OF THE SOFTWARE AND AGREEING TO B ECOME BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, THEN SELECT THE "CANCEL" BUTTON, DO NOT INSTALL THE SOFTWARE AND RE TURN THE SOFTWARE TO YOUR PLACE OF PURCHASE FOR A FULL REFUND.
USING THE SOFTWARE. 4.1. You may use the SOFTWARE according to the scope of Your License. 4.2. You may install the SOFTWARE without the SOFTWARE Activation on unlimited number of Computers 4.3. You may simultaneously run or use as many copies of the SOFTWARE as permitted by the scope of Your License. 4.4. If You access the SOFTWARE by using Terminal Services, You may simultaneously run or use as many copies of the SOFTWARE as permitted by the scope of Your License and stipulated in this ▇▇▇▇. 4.5. You agree to indemnify, hold harmless, and defend Artsyl from and against any claims, liabilities, losses, actions, damages and/or or lawsuits, including any attorneys’ fees, that may arise from or relate to the use of and/or reliance on the SOFTWARE.
USING THE SOFTWARE. Subject to your compliance with the remainder of this clause 2 and your payment of the Licence Fee, Devicedesk grants you a non-exclusive, limited, non-sublicensable, non-transferable licence to access and use the Software during the Term. You must not (and you must procure that the Authorised Individuals must not), without Devicedesk's prior written approval: access or use the whole or any part of the Software, except as expressly authorised by this Agreement or otherwise with the prior written consent of Devicedesk; use the Software to assist in the conduct of the business of any third party, if that third party would otherwise require a licence to use the Software for that conduct; modify, adapt or amend the Software, or permit any third party to modify, adapt or amend the Software; copy or replicate, or directly or indirectly allow or cause a third party to copy or replicate, the whole or part of any of the Software except and strictly only to the extent such copying is necessary for the normal use of the Software; at any time do or cause to be done any act or thing contesting or in any way impairing any of Devicedesk's Intellectual Property Rights, including removing or obscuring any proprietary notice (including any copyright, trade mark, service mark, tagline) or other notices contained in the Software; modify Devicedesk's intellectual property or merge all or any part of Devicedesk's intellectual property with any other intellectual property, other than for the purpose of this Agreement or as directed by Devicedesk; circumvent any mechanisms in the Software intended to limit an Authorised Individual's or your use of or access to areas within or components of the Software; vary, alter, modify, interfere with, reverse disassemble, decompile or reverse engineer, or otherwise seek to obtain or derive the source code from, or directly or indirectly allow or cause a third party to vary, alter, modify, interfere with, reverse disassemble, decompile or reverse engineer or obtain or derive the source code from, the whole or any part of the Software or otherwise attempt or allow any other party to attempt to obtain the algorithms by which the Software performs functions, except as permitted by Law; publicly disseminate information regarding the performance of the Software; use any data mining, gathering or extraction tools in connection with the Software, without Devicedesk's prior written consent; or sub-licence, rent, sell, lease, distribute or otherwise t...
USING THE SOFTWARE. 2.1 We give you the personal right (known as a ’lic ence’) to download, install (and enjoy!) the Software for your personal use. We can terminate t his licence in certain circumstances, which are explained further below. This licence is ’non- exclusive’, meaning that we can grant similar licences to other people as well. 2.2 You may not transfer or sub-license this licenc e in any way to anyone else unless we first agree to it in writing.
