Common use of Utility Lines Clause in Contracts

Utility Lines. Lessor shall have the non-exclusive right to construct, operate, maintain, and use any and all types of pipe, power, transportation and communication lines, or the equivalent thereof, on and through the Surface Property. Lessor shall exercise the rights excepted and reserved in this Section 1.05 in such a way as to not unreasonably interfere with, and in such a way as to minimize the inconvenience to, the Lessee’s operations hereunder. In the exercise of all rights excepted and reserved in this Section 1.05, Lessor shall comply with (i) the terms and provisions of all laws, rules and regulations of any government or agency having jurisdiction over the Surface Property, and (ii) any and all permit and bonding requirements of Lessee governing the operations of Lessee on the Surface Property.
