Common use of Validity and Effect Clause in Contracts

Validity and Effect. The validity and effect of this Lease shall not be impaired in any way by the failure of Landlord to complete the repair and restoration of the Property or the Building within one hundred eighty (180) days after the occurrence of the casualty, even if Landlord had in good faith notified Tenant that the repair and restoration would be completed within such period, provided that Landlord proceeds diligently with such repair and restoration; provided, however, if the Property or the Building are not restored within two hundred and ten (210) days after the occurrence of the casualty, Tenant shall have the right to terminate this Lease by written notice to Landlord.
