Common use of Variations from Engineer's Estimate Clause in Contracts

Variations from Engineer's Estimate. The Engineer's Estimate of the quantity of excavation for which additional payment will be made is approximate only, and given solely for use as a uniform basis for the comparison of Bids. Such estimate shall not be considered part of this Contract. The quantities actually required to complete the Contract Work may be more or less than the quantities in the Engineer's Estimate and, if so, no action for damages or for loss of profits shall accrue to the Contractor by reason thereof.
