Common use of Vat Breakdown or Power Failure Clause in Contracts

Vat Breakdown or Power Failure. Effective cooling of milk is integral to milk quality. Regular maintenance of cooling and backup systems and performance checks (including peak volume and peak temperature) support this. Milk Department encourage Farmers to have backup systems in place e.g., a generator. to assist in ensuring milk is always available for collection at or below 4oC. If a vat or power failure eventuates, the Farmer should immediately notify a Milk Department Field Services Contact. Milk Department will then endeavour to find a solution for the Farmer so their contractual obligations can be fulfilled. If cooling system maintenance is required or a power outage due to supply maintenance is scheduled, the Milk Department Field Services Contact needs to be notified of the date and relevant time periods so that alternative transport scheduling can be arranged. Additional milk collections can be requested to minimise the impact of any incident. The Milk Department will endeavour to arrange alternative collection and delivery arrangements to enable the sale of effected milk. The cost associated with such additional milk collections may be charged to the farmer. In all situations above the milk must meet all quality parameters of Australian and New Zealand Food Safety Standards and/or those set out in the MPA.
