Common use of Vehicle Fleet Size Clause in Contracts

Vehicle Fleet Size. a. A maximum total of 5,000 electric-assisted bicycles will be authorized by the City under the Ordinance among all licensees. b. Up to 1,500 electric-assisted bicycles with a minimum of 1,250 electric- assisted bicycles must be made available for public use no later than thirty (30) days after initial deployment, and deployment of bicycles must begin within seven (7) days of April 3, 2024, unless otherwise notified by the City. Licensee must have full allotment of electric-assisted bicycles in the market no later than thirty (30) days after initial deployment, and available to deploy to meet demand. Starting on November 15th, 2024, unless otherwise notified by the City, Licensee may reduce their fleet below 1250 electric-assisted bicycles without penalty in preparation for the end of the season. c. A maximum total of 3,000 motorized foot scooters will be authorized by the City under the Ordinance among all licensees. d. Deployment of scooters must begin within seven (7) days of April 3, 2024 unless otherwise notified by the City. Licensee must have up to 900 with a minimum of 650 motorized foot scooters available for public use no later than 30 days after initial deployment. e. If any Licensee declines to use their full initial deployment of electric assisted bicycles or motorized foot scooters, the City reserves the right to redistribute the remaining vehicles to another Licensee. f. Availability to the public will be defined by the number of scooters available to rent in the public right of way. including a +/- 5% variance for unaccounted vehicles in use. g. If at any point during the license period the Licensee's fleet drops below their initial deployment level, including a +/- 10% variance for unaccounted vehicles in use, a penalty will be assessed as outlined in the Parking and Mobility Services Fee and Rate Schedule. Starting on November 15th, 2024, unless otherwise notified by the City, Licensee may reduce their fleet below the initial deployment level of motorized foot scooters without penalty in preparation for the end of the season. h. The City will hold compliance meetings as defined by Section 3(a) with Licensee to review compliance and utilization data. o The City will review fleet size and utilization monthly. o If the average rides per electric-assisted bicycle per day is greater than or equal to one (1) during the prior month, and the Licensee was in compliance during the prior compliance period, then Licensee may make available an additional 250 electric-assisted bicycles for public use until the maximum allotment is reached. If the average rides per electric- assisted bicycle per day is greater than or equal to one and a half (1.5) during the prior month, and the Licensee was in compliance during the prior compliance period, then Licensee must make available an additional 250 electric-assisted bicycles for public use within fourteen (14) days until the maximum allotment is reached. o If at the monthly utilization review, the average rides per electric- assisted bicycles per day during the prior month is less than or equal to three-quarters (.75) of a ride, then the Licensee may request a reduction in their fleet size of up to 10%. o If the average rides per scooter per day is greater than or equal to three (3) during the prior month, and the Licensee was in compliance during the prior compliance period, then Licensee shall make available an additional 250 scooter for public use within fourteen (14) days until the maximum allotment is reached. If a fleet increase has previously been granted and the average rides per scooter per day is less than two (2) during the previous month, then Licensee shall reduce the number of scooters available for public use by 125 within seven (7) days of the review. Fleet size will never decrease below the initial deployment level and increases will be available until the maximum total, as defined in 1(a) is attained. i. Licensee shall notify the City when reducing the number of fleet vehicles available for public use due to weather or emergency situations.

If the average rides per electric- electric-assisted bicycle per day is greater than or equal to one and a half (1.5) during the prior month, and the Licensee was in compliance during the prior compliance period, then Licensee must make available an additional 250 electric-assisted bicycles for public use within fourteen (14) days until the maximum allotment is reached. o If at the monthly utilization review, the average rides per electric- assisted bicycles per day during the prior month is less than or equal to three-quarters (.75) of a ride, then the Licensee may request a reduction in their fleet size of up to 10%. The Licensee may request a fleet reduction if the average rides per electric-assisted bicycles per day if the number is between .75 and one (1), but the city is unlikely to grant the request absent extenuating circumstances. o If the average rides per scooter per day is greater than or equal to three two and half (32.5) during the prior month, and the Licensee was in compliance during the prior compliance period, then Licensee shall make available an additional 250 scooter for public use within fourteen (14) days until the maximum allotment is reached. If a fleet increase has previously been granted and the average rides per scooter per day is less than two one and half (21.5) during the previous month, then Licensee shall reduce the number of scooters available for public use by 125 within seven (7) days of the review. Fleet size will never decrease below the initial deployment level level, unless the operator requests a fleet reduction due to low utilization, and increases will be available until the maximum total, as defined in 1(a) is attained. i. Licensee shall notify the City when reducing the number of fleet vehicles available for public use due to weather or emergency situations.
