Vehicle operators. All potential vehicle operators shall have a safe driving record and current Class C driver's license. All vehicle operators shall be 18 years of age or older. Potential vehicle operators shall be subject to driving record and criminal background checks through the California Highway Patrol. Potential vehicle operators shall be sufficiently trained and experienced in the tasks of tow truck operations and proficient with all required Freeway Service Patrol equipment to provide safe and proper service. Any certified driver from other FSP areas will be evaluated on a case by case basis. All potential vehicle operators must be capable of demonstrating their tow operating abilities prior to formal CHP training. Additionally, the vehicle operators will be required to exercise good, sound judgment in carrying out their duties. FSP vehicle operators shall be required to inform the CHP Communications Center at any time he/she leaves the assigned beat for more than 10 minutes. This includes replenishing expendable items such as gasoline, fire extinguisher, breaks, etc. The vehicle operator shall be required to immediately notify the CHP Communications Center upon a truck breakdown. The FSP vehicle operator shall be required to complete assist records for each incident. The CHP, Caltrans, and SBC SAFE maintain strict drug and alcohol policies. Contractors shall have an alcohol and drug program that includes at a minimum, a drug and alcohol free workplace policy, and an employee alcohol/drug-testing program. Any Freeway Service Patrol vehicle operator found working under the influence of drugs or alcohol shall be immediately removed from the FSP program by the Contractor. The Contractor shall be responsible for providing a certified replacement vehicle operator for that vehicle. The Contractor shall also be an active participant in the DMV Pull Notice Program. If a vehicle operator is convicted of a crime involving a stolen vehicle, stolen property, violence, drugs or moral turpitude, fraud related to the towing business, or misdemeanor or felony driving while under the influence of alcohol or a drug, the Contractor shall permanently remove that vehicle operator from duties under the FSP program. If a vehicle operator is charged with any of the above crimes, the Contractor shall immediately suspend that vehicle operator from duties under this program pending the outcome of the criminal case. If the vehicle operator is not convicted, or is ultimately convicted of a lesser crime not described above, SBC SAFE retains the right to have the Contractor remove that vehicle operator from the duties under the FSP program. All FSP vehicle operators, including back-up drivers, shall be required at Contractor’s expense to complete the CHP two-day training program in Los Angeles which costs up to $55.00 per driver. Contractors shall pay all FSP operators and back-up drivers for attending the training. No driver will be allowed to begin patrolling without attending the mandatory training classes. Any FSP vehicle operator who is found on patrol without completing the mandatory training classes may be prohibited from further FSP service and this Agreement may be terminated immediately. Mandatory CHP refresher training classes shall be scheduled during non-Freeway Service Patrol hours. A minimum of eight (8) hours refresher training per year shall be required (at Contractor’s expense). Courtesy and professionalism are mandatory for all FSP vehicle operators towards all motorists and passengers assisted.

If the vehicle operator is not convicted, or is ultimately convicted of a lesser crime not described above, SBC SAFE retains the right to have the Contractor remove that vehicle operator from the duties under the FSP program. Before hiring or assigning a driver, the CONTRACTOR will have completed a criminal background check on the individual. This check will be conducted through a commercially available service for attending Alameda County. No person who has been convicted of any felony or a misdemeanor for a crime against a person (including but not limited to murder, attempted murder, assault, sexual assault, or battery) shall be assigned to service or deliver service under this contract. As used in this paragraph, “convicted” includes a jury verdict, a determination of guilt after a trial by judge, a guilty plea or a plea of nolo contendere or no contest. The CONTRACTOR, to the trainingbest of their knowledge, will notify the CITY of any such charges brought after a driver is employed. If the CITY desires a national or FBI background check, CONTRACTOR will submit fingerprint cards to CITY police department, who will conduct the background check. Vehicle operators must have a valid California driver's license of the appropriate classification for the vehicle type to be driven, as well as any other licenses or certifications required by applicable federal, state or local regulations. The CONTRACTOR must also comply with the requirements of the Drug Free Work Place Act of 1988 and U.S. Department of Transportation drug testing regulations to extent they are legally enforceable. Drivers are expected to observe all federal, state and local regulations and ordinances governing the safe operation of a commercial, public transit vehicle. No driver will be allowed to begin patrolling without attending the mandatory training classes. Any FSP vehicle operator who is found on patrol without completing the mandatory training classes may be prohibited from further FSP service and this Agreement may be terminated immediately. Mandatory CHP refresher training classes shall be scheduled during non-Freeway Service Patrol hoursemployed or assigned to the CITY service who has had a conviction for DWI or DUI. A No driver shall be employed or assigned to the CITY service who has more than five (5) points against their driver’s license within the past three (3) years or has received six (6) or more substantiated service complaints. Drivers must be licensed for a minimum of eight three (8) hours refresher 3) years; be able to read, write, speak, and understand English. Prior to final assignment, all drivers must participate in and successfully complete the standardized driver orientation and training per year course administered by the CONTRACTOR. Drivers shall be required by the CONTRACTOR to wear uniforms and identification badges that are approved by the CITY. Drivers will at all times maintain proper grooming and personal hygiene. All drivers must have accurate timepieces available at all times during vehicle operation. If required by the passenger, drivers will provide assistance between the bus and the first set of exterior doors at the trip origin or destination. This could include help carrying up to two (2) grocery bags or small packages. (Section 2.3 for Door-to-Door Service) Drivers will collect all data required by the CITY to be used in preparing reports and passenger surveys. Drivers will update all hardcopy manifests as directed by the dispatcher, recording all cancellations, no-shows, add-ons, and walk-on boardings by designated bus stop. Separate manifests will be maintained for each individual scheduled run. Drivers will maintain constant radio communication with service dispatchers. Drivers will follow directions on their manifests and directions from the service dispatchers regarding trip assignments and changes to driver manifests. Drivers will report all accidents and incidents to the service dispatchers via two-way radio as well as all trip cancellations at Contractor’s expense)the door, no-shows, passenger overloads and pass ups, schedule adherence problems, and any discrepancies with trip information provided on the driver manifests. Courtesy Drivers will be responsible for the collection and professionalism are mandatory for safeguard of all FSP vehicle operators towards all motorists and passengers assistedfares and/or fare medium.
