Common use of Waiting List Clause in Contracts

Waiting List. On a first-come, first-served basis governed by the date of receipt of an Application or Letter of Intent, BellSouth will maintain a waiting list of requesting carriers who have either received a Denial of Application or, where it is publicly known that the Premises is out of space, have submitted a Letter of Intent to collocate. BellSouth will notify the telecommunications carriers on the waiting list that can be accommodated by the amount of space that becomes available according to the position of the telecommunications carriers on said waiting list. 6.7.1 In Florida, on a first-come, first-served basis governed by the date of receipt of an Application or Letter of Intent, BellSouth will maintain a waiting list of requesting carriers who have either received a Denial of Application or, where it is publicly known that the Premises is out of space, have submitted a Letter of Intent to collocate. A CLEC that, upon denial of physical collocation, requests virtual collocation shall be automatically placed on the waiting list. 6.7.2 When space becomes available, ALEC Inc., must submit an updated, complete, and correct Application to BellSouth within 30 calendar days (in Mississippi, 30 business days) of such notification. If ALEC Inc., has originally requested caged collocation space and cageless collocation space becomes available, ALEC Inc., may refuse such space and notify BellSouth in writing within that time that ALEC Inc., wants to maintain its place on the waiting list without accepting such space. ALEC Inc., may accept an amount of space less than its original request by submitting an Application as set forth above, and upon request, may maintain its position on the waiting list for the remaining space that was initially requested. If ALEC Inc., does not submit such an Application or notify BellSouth in writing as described above, BellSouth will offer such space to the next CLEC on the waiting list and remove ALEC Inc., from the waiting list. Upon request, BellSouth will advise ALEC Inc., as to its position on the list.

Upon request, BellSouth will advise ALEC Inc., WebShoppe as to its position on the list.

ALEC Inc., DSLi may accept an amount of space less than its original request by submitting an Application as set forth above, and upon request, may maintain its position on the waiting list for the remaining space that was initially requested. If ALEC Inc., DSLi does not submit such an Application or notify BellSouth in writing as described above, BellSouth will offer such space to the next CLEC on the waiting list and remove ALEC Inc., DSLi from the waiting list. Upon request, BellSouth will advise ALEC Inc., DSLi as to its position on the list.

A CLEC telecommunications carrier that, upon denial of physical collocationCollocation Space, requests virtual collocation Collocation Space shall automatically be automatically placed on the waiting listlist for physical Collocation Space that may become available in the future. 6.7.2 6.8.2 When space physical Collocation Space becomes available, ALEC Inc., PTLLC must submit an updated, complete, and correct Application accurate application to BellSouth within 30 thirty (30) calendar days (of notification by BellSouth that physical Collocation Space will be available in Mississippi, 30 business days) the requested BellSouth Premises previously out of such notificationspace. If ALEC Inc., PTLLC has originally requested caged collocation space Collocation Space and cageless collocation space Collocation Space becomes available, ALEC Inc., PTLLC may refuse such space and notify BellSouth in writing writing, within the thirty (30) day timeframe referenced above, that time that ALEC Inc., PTLLC wants to maintain its place on the waiting list for caged physical Collocation Space, without accepting such spacethe available cageless Collocation Space. If ALEC Inc., ACCESS Integrated has originally requested caged collocation space Remote Collocation Space and cageless collocation space Remote Collocation Space becomes available, ALEC Inc., ACCESS Integrated may refuse such space and notify BellSouth in writing writing, within the thirty (30) day timeframe referenced above, that time that ALEC Inc., wants ACCESS Integrated wishes to maintain its place on the waiting list for caged Remote Collocation Space, without accepting such spacethe available cageless Remote Collocation Space. ALEC Inc., ACCESS Integrated may accept an amount of space less than its original request what it originally requested by submitting an Application as set forth above, and and, upon request, may maintain its position on the waiting list for the remaining space that was initially requested. If ALEC Inc., ACCESS Integrated does not submit such an Application or notify BellSouth in writing within the thirty (30) day timeframe as described above, BellSouth will offer such space the available Remote Collocation Space to the next CLEC telecommunications carrier on the waiting list and remove ALEC Inc., ACCESS Integrated from the waiting list. Upon request, BellSouth will advise ALEC Inc., ACCESS Integrated as to its position on the listwaiting list for a particular Remote Site Location.

NOS Communications, Inc. must submit an updated, complete, and correct Application to BellSouth within 30 calendar days (in Mississippi, 30 business days) of such notification or notify BellSouth in writing within that time that NOS Communications, Inc. wants to maintain its place on the waiting list either without accepting such space or accepting an amount of space less than its original request. If NOS Communications, Inc. does not submit such an Application or notify BellSouth in writing as described above, BellSouth will offer such space to the next CLEC on the waiting list and remove NOS Communications, Inc. from the waiting list. Upon request, BellSouth will advise NOS Communications, Inc. as to its position on the list. 6.7.1 2.5.1 In Florida, on a first-come, first-served basis governed by the date of receipt of an Application or Letter of Intent, BellSouth will maintain a waiting list of requesting carriers who have either received a Denial of Application or, where it is publicly known that the Premises is out of space, have submitted a Letter of Intent to collocate. If ALEC Inc.NOS Communications, Inc. has originally requested caged collocation space Collocation Space and cageless collocation space Collocation Space becomes available, ALEC Inc.NOS Communications, Inc. may refuse such space and notify BellSouth in writing within the thirty (30) day timeframe that time that ALEC Inc.NOS Communications, Inc. wants to maintain its place on the waiting list list, without accepting such spacethe available cageless Collocation Space. ALEC Inc.NOS Communications, Inc. may accept an amount of space less than its original request originally requested space by submitting an Application application as set forth above, and upon request, may maintain its position on the waiting list for the remaining space that was initially requested. Upon request, BellSouth will advise ALEC Inc.NOS Communications, Inc. as to its position on the waiting list.

Waiting List. On Unless otherwise specified, on a first-come, first-served basis governed by the date of receipt of an Application or Letter of Intent, BellSouth will maintain a waiting list of requesting carriers who have either received a Denial of Application or, where it is publicly known that the Premises Remote Site Location is out of space, have submitted a Letter of Intent to collocate. BellSouth will notify the telecommunications carriers on the waiting list that can be accommodated by the amount of when space that becomes available according to how much space becomes available and the position of the telecommunications carriers carrier on said waiting list. Network Telephone must submit an updated, complete, and correct Application to BellSouth within 30 calendar days (in Mississippi, 30 business days) or notify BellSouth in writing that Network Telephone wants to maintain its place on the waiting list either without accepting such space or accepting an amount of space less than its original request. If Network Telephone does not submit such an Application or notify BellSouth in writing as described above, BellSouth will offer such space to the next CLEC on the waiting list and remove Network Telephone from the waiting list. BellSouth will notify Powertel when space becomes available according to how much space becomes available and the position of Powertel (vis-à-vis other telecommunications carriers carriers) on said waiting list. Powertel must submit an updated, complete, and correct Application to BellSouth within 30 calendar days (in Mississippi, 30 business days) of such notification or notify BellSouth in writing within that time that Powertel wants to maintain its place on the waiting list that can be accommodated by the either without accepting such space or accepting an amount of space less than its original request. If Powertel does not submit such an Application or notify BellSouth in writing that becomes available according Powertel wishes to maintain its position on the waiting list as described above, BellSouth will offer such space to the next CLEC on the waiting list and remove Powertel from the waiting list. If ALEC Inc., does not submit such an Application or notify BellSouth in writing as described above, BellSouth will offer such space to the next CLEC on the waiting list and remove ALEC Inc., from the waiting list. Upon request, BellSouth will advise ALEC Inc., as to its position on the list.

If ALEC Inc., DukeNet has originally requested caged collocation space Collocation Space and cageless collocation space Collocation Space becomes available, ALEC Inc., DukeNet may refuse such space and notify BellSouth in Version 1Q03: 02/28/03 writing within the thirty (30) day timeframe that time that ALEC Inc., DukeNet wants to maintain its place on the waiting list list, without accepting such spacethe available cageless Collocation Space. ALEC Inc., DukeNet may accept an amount of space less than its original request originally requested space by submitting an Application application as set forth above, and upon request, may maintain its position on the waiting list for the remaining space that was initially requested. If ALEC Inc., GulfPines has originally requested caged collocation space Collocation Space and cageless collocation space Collocation Space becomes available, ALEC Inc., GulfPines may refuse such space and notify BellSouth in writing within the thirty (30) day timeframe that time that ALEC Inc., GulfPines wants to maintain its place on the waiting list for caged Physical Collocation Space, without accepting such spacethe available cageless Collocation Space. BellSouth will notify the telecommunications carriers on the waiting list that can be accommodated by the amount of space that becomes available according to the position of the telecommunications carriers on said waiting list. 6.7.1 In Florida, on a first-come, first-served basis governed by the date of receipt of an Application application or Letter of Intent, BellSouth will maintain a waiting list of requesting carriers who have either received a Denial of Application or, where it is publicly known that the Premises Remote Site Location is out of space, have submitted a Letter of Intent to collocate. Sixty (60) calendar days prior to space becoming available, if known, BellSouth will notify the Florida PSC and the telecommunications carriers on the waiting list by mail when space becomes available according to the position of the telecommunications carrier on said waiting list. If not known sixty (60) calendar days in advance, BellSouth shall notify the Florida PSC and the telecommunications carriers on the waiting list within two business days of the determination that space is available. A CLEC telecommunications carrier that, upon denial of physical collocation, requests virtual collocation shall be automatically placed on the waiting list. 6.7.2 When space becomes available, ALEC Inc., DukeNet must submit an updated, complete, and correct Application application to BellSouth within 30 thirty (30) calendar days (in Mississippi, 30 business days) of such notification. If ALEC Inc., DukeNet has originally requested caged collocation space Remote Collocation Space and cageless collocation space Remote Collocation Space becomes available, ALEC Inc., DukeNet may refuse such space and notify BellSouth in writing within that time that ALEC Inc., DukeNet wants to maintain its place on the waiting list without accepting such space. ALEC Inc., DukeNet may accept an amount of space less than its original request by submitting an Application application as set forth above, and upon request, may maintain its position on the waiting list for the remaining space that was initially requested. If ALEC Inc., DukeNet does not submit such an Application application or notify BellSouth ▇▇▇▇▇▇▇▇▇ in writing as described above, BellSouth will offer such space to the next CLEC telecommunications carrier on the waiting list and remove ALEC Inc., DukeNet from the waiting list. Upon request, BellSouth will advise ALEC Inc., DukeNet as to its position on the list.
