Waiver of Certain Representative Actions. The Parties knowingly agree to waive their rights to initiate or maintain or participate in a Non-individual Covered Claim on a representative action basis either in court or arbitration to the extent such a waiver does not extinguish any substantive rights, and, to the maximum extent permitted by law, will not be entitled to and will decline to accept any recovery from such an action.
