Common use of Warrantholder not a Shareholder Clause in Contracts

Warrantholder not a Shareholder. Nothing in this Indenture or in the holding of a Warrant evidenced by a Warrant Certificate, or otherwise, is intended or will confer or be construed as conferring on any Warrantholder any right or interest whatsoever as a shareholder of WorldHeart, including but not limited to any right to vote at, to receive notice of, or to attend any meeting of shareholders or any other proceeding of WorldHeart or any right to receive any dividend or other distribution to which the shareholders of WorldHeart may be entitled.
