Warranties Disclaimer and Limitation of Liability. 5.1 EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, BARBOOKS™ IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, NONINFRINGEMENT, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. 5.2 OSB’S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY FOR ANY CLAIM FOR DAMAGES UNDER ANY LEGAL THEORY WILL BE A PRORATED REFUND OF THE LICENSE FEE FOR THE PERIOD DURING WHICH THE EVENT COMPLAINED OF OCCURRED OR, AT OSB’S DISCRETION, AN EXTENSION OF YOUR LICENSE TERM FOR A SPECIFIED PERIOD, WITHOUT COST. 5.3 OSB neither represents nor warrants that BARBOOKS™ is accurate, correct, or error-free, or that it will meet your requirements. BARBOOKS™ is intended only as a starting point in your legal research and the accompanying forms are only a starting point in developing an appropriate document to use in a particular matter.
