WARRANTY BY THE UNIVERSITY. 10.1 The University warrants that it has the lawful right to grant this license, subject to DOE assignment of rights in the Technology to the University in the event such rights have not yet been assigned to the University. 10.2 This license and the associated Technology and Patent Rights are provided WITHOUT warranty of merchantability or fitness for a particular purpose or any other warranty, express or implied. The University makes no representation or warranty that any Licensed Products or Licensed Methods will not infringe any patent or other proprietary right of any third party.
