Where there is disagreement. If and insofar as there is any disagreement between the Operator and the Recipient as to :- 9.5.1 whether the consent of the Recipient is required pursuant to Clause 3.4 to the intended Discontinuation; or 9.5.2 whether any such consent is being unreasonably withheld or delayed; or 9.5.3 the practicability or appropriateness of any proposed alternative arrangements or any proposed temporary or transitional arrangements; or 9.5.4 the terms on which any temporary or transitional arrangements should be put in place, either party may, within two months following receipt by the Recipient of the notification or within such other period as the parties may agree prior to the expiry of such period, give notice to the other that a dispute exists between them in relation to that issue and referring the dispute for resolution in accordance with Part 9. In such event the person appointed pursuant to Part 9 to determine such dispute shall, without prejudice to his other powers, have the powers referred to in paragraph 3 of Schedule 3 (Part 2).

  • Dispute Notice If there is a dispute between the parties, then either party may give a notice to the other succinctly setting out the details of the dispute and stating that it is a dispute notice given under this clause 17.1.

  • Disagreement on Decision Should the parties disagree as to the meaning of the Board's decision, either party may apply to the Chairperson of the Arbitration Board to reconvene the Board to clarify the decision, which it shall make every effort to do within seven days.
