In all situations where an Employer is required to agree to a testing program in order to qualify as a bidder on a project, testing may be required, but only if performed in accordance with these standards and applied uniformly to all personnel having access to the workplace. Where work opportunity mandated testing has taken place, the employee may elect (where permitted) to have the results of that testing transmitted to this drug-testing program. Those results could then be used in certain future work opportunity mandated testing so that those employees who had been tested recently could avoid being retested.
