Common use of WORK TO BE DONE Clause in Contracts

WORK TO BE DONE. In accordance with Notice to Owner No. ST-69-IID-Transmission dated February 11, 2025, OWNER shall relocate existing electrical facilities in conflict the proposed project. All work shall be performed substantially in accordance with OWNER's Plan No. 60147493 dated January 14, 2025, consisting of four (4) sheets, a copy of which is on file in the Office of the CITY at City of Coachella, City Hall at ▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇ ▇▇▇, ▇▇▇▇▇▇▇▇▇, ▇▇ ▇▇▇▇▇. Deviations from the OWNER’s plan described above initiated by either the CITY or the OWNER, shall be agreed upon by both parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by the CITY and agreed to/ acknowledged by the OWNER, will constitute an approved revision of the OWNER’s plan described above and are hereby made a part hereof. No work under said deviation shall commence prior to written execution by the OWNER of the Revised Notice to Owner. Changes in the scope of the work will require an amendment to this Agreement in addition to the revised Notice to Owner. It is mutually agreed that the CITY will include the work of OWNER’s future conduits installation in the bridge as part of the CITY's highway construction contract. OWNER shall have access to all phases of the work to be performed by the CITY for the purpose of inspection to ensure that the work being performed for the OWNER is in accordance with the specifications contained in the highway contract. Upon completion of the work performed by CITY, OWNER agrees to accept ownership and maintenance of the constructed facilities and relinquishes to CITY ownership of the replaced facilities.

Deviations from the OWNER’s plan described above initiated by either the CITY STATE or the OWNER, shall be agreed upon by both parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by the CITY STATE and agreed to/ to/acknowledged by the OWNER, will constitute an approved revision of the OWNER’s plan described above and are hereby made a part hereof. It is mutually Work Performed by State’s Contractor per State’s Plans: “In accordance with Notice to Owner No. dated , STATE shall relocate OWNER’s as shown on STATE’s contract plans for the improvement of State Route , EA which by this reference are made a part hereof. OWNER hereby acknowledges review of STATE’s plans for work and agrees to the construction in the manner proposed. Deviations from the plan described above initiated by either the STATE or the OWNER, shall be agreed that upon by both parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by the CITY STATE and agreed to/acknowledged by the OWNER, will include constitute an approved revision of the plan described above and are hereby made a part hereof. No work under said deviation shall commence prior to written execution by the OWNER of the Revised Notice to Owner. Changes in the scope of the work of OWNER’s future conduits installation will require an amendment to this Agreement in addition to the bridge as part of the CITY's highway construction contractrevised Notice to Owner. OWNER shall have access the right to all phases of inspect the work to be performed by the CITY for the purpose of inspection to ensure that the work being performed for the OWNER is in accordance with the specifications contained in the highway contractduring construction. Upon completion of the work performed by CITYSTATE, OWNER agrees to accept ownership and maintenance of the constructed facilities and relinquishes to CITY STATE ownership of the replaced facilities, except in the case of liability determined pursuant to Water Code 7034 or 7035.”

WORK TO BE DONE. In accordance with Notice to Owner No. ST-69-IID-Transmission 2707.6L dated February 1106/08/2017, 2025, OWNER STATE shall relocate OWNER’s existing electrical 12" water line facilities in conflict the proposed project. All work shall be performed substantially in accordance with as shown on OWNER's ’s Plan No. 60147493 Sheets W-1 thru W-4, dated January 1406/19/2017, 2025, consisting which plans are included in STATE’s Contract Plans for the improvement of four (4) sheets, a copy of which is on file in the Office of the CITY at City of Coachella, City Hall at State ▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇ ▇▇▇, ▇▇▇▇▇▇▇▇▇, ▇▇ ▇▇▇▇▇▇ which, by this reference, are made a part hereof. In accordance with Notice to Owner No. ST-69-IID-Transmission 002, dated February 11, 202511/10/2020, OWNER shall relocate existing electrical facilities in conflict perform the proposed projectfollowing activities: design engineering for the preparation of plans and specifications, inspection, water quality testing, attend meetings, review submittals, and provide project management. All work shall be performed substantially in accordance inaccordance with OWNER's Project No. 120602, Plan No. 60147493 D-16146 to D-16148, dated January 14, 202510/21/20, consisting of four (4) 3 sheets, a copy of which is on file in the Office of the CITY LOCAL AGENCY at City of Coachella, City Hall at ▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇▇▇ ▇▇▇, ▇▇▇▇▇▇▇▇▇, ▇▇ ▇▇▇▇▇. Deviations from the OWNER’s plan described above initiated by either the CITY LOCAL AGENCY or the OWNER, shall be agreed upon by both parties hereto under a Revised Notice to Owner. Such Revised Notices to Owner, approved by the CITY LOCAL AGENCY and agreed to/ acknowledged by the OWNER, will constitute an approved revision of the OWNER’s plan described above and are hereby made a part hereof. No work under said deviation shall commence prior to written execution by the OWNER of the Revised Notice to Owner. Changes in the scope of the work will require an amendment to this Agreement in addition to the revised Notice to Owner. It is mutually agreed that the CITY will include the work of LOCAL AGENCY shall: relocate OWNER’s future conduits installation existing 8” PVC water service line, relocate a hydrant, and relocate two appurtenant valves and valve boxes located within OWNER’s easement at ▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇, Concord, CA 94520 (“WORK SCOPE A”); relocate OWNER’s two manholes, relocate a hydrant, and relocate 5 valves and valve boxes within the Public Road Right-of-Way on ▇▇▇▇▇ Drive (“WORK SCOPE B”); and relocate a 4” PVC water service line, a 2” copper water service line, a water meter, and a fire service line on private property located at ▇▇▇▇ ▇▇▇▇▇ ▇▇▇▇▇, Concord, CA 94520 (“WORK SCOPE C”) as shown on OWNER’s Project No. 120602, Plan Nos. D-16146 to D-16148, dated 3/19/20, consisting of 3 sheets, which plans are included in the bridge LOCAL AGENCY’s Contract Plans as part of the CITY's LOCAL AGENCY’s highway construction contract. ..OWNER shall have access to all phases of the work to be performed by the CITY LOCAL AGENCY for the purpose of inspection to ensure that the work being performed for the OWNER is in accordance with the specifications contained in the highway contract. Upon completion of the work performed by CITYLOCAL AGENCY, OWNER agrees to accept ownership and maintenance of the constructed facilities and relinquishes to CITY LOCAL AGENCY ownership of the replaced facilities, except in the case of liability determined pursuant to Water Code 7034 or 7035. LOCAL AGENCY will obtain environmental compliance and regulatory permits necessary for the LOCAL AGENCY’s highway construction contract. OWNER will lead (and the LOCAL AGENCY shall support) coordination with OWNER’s water customers for potential impacts during design and construction. LOCAL AGENCY shall include language in the LOCAL AGENCY’s highway construction contract requiring the contractor to maintain water service at all times. The LOCAL AGENCY is to maintain continuous emergency response capability for repairing damage to the existing water facilities within four (4) hours of becoming aware of or being notified of damage, and is to repair such damage and shall notify OWNER of such emergency. The costs of these conditions will be included in the WATER FACILITIES bid items.
