WORKING PRIOR TO NOTICE TO PROCEED Clause Samples

The "Working Prior to Notice to Proceed" clause defines the conditions under which a contractor may begin work before receiving the formal Notice to Proceed from the project owner. Typically, this clause outlines what types of preparatory activities, such as site mobilization or ordering materials, are permitted and clarifies whether any compensation or liability is associated with this early work. Its core function is to manage risk and expectations by specifying the extent and limitations of work allowed before the official project start, thereby preventing disputes over unauthorized work or costs incurred prior to formal approval.
