(i) Provide your Plan Agreement Number and regulationsa copy of your Plan’s original proof of purchase, including those in any jurisdictions in which You make content, functionality, services or subscriptions available through if requested;
(ii) Provide information about the use symptoms and causes of the In-App Purchase APIissues with the Covered Equipment;
(iii) Respond to requests for information, including but not limited to consumer laws and export regulations.
3.3 Apple may provide hosting services for Non-Consumables that You would like to provide to Your end-users through the use Covered Equipment serial number, model, version of the In-App Purchase API. Even if operating system and software installed, any peripherals devices connected or installed on the Covered Equipment, any error messages displayed, actions taken before the Covered Equipment experienced the issue and steps taken to resolve the issue;
(iv) Follow instructions Apple hosts such Non- Consumables on Your behalf, You are responsible for providing items ordered through the In-App Purchase API in a timely manner (i.e., promptly after Apple issues the transaction receipt, except in cases where You have disclosed to Your end-user that the item will be made available at a later time) and for complying with all applicable laws in connection therewithgives you, including but not limited toto refraining from sending Apple products and accessories that are not subject to repair or replacement service and packing the Covered Equipment in accordance with shipping instructions;
(v) Update software to currently published releases prior to seeking service; and
(vi) Make sure to backup software and data residing on the Covered Equipment. APPLE MAY REINSTALL THE COVERED EQUIPMENT’S ORIGINAL SOFTWARE CONFIGURATION AND SUBSEQUENT UPDATE RELEASES WHILE PERFORMING SERVICE, lawsWHICH WILL RESULT IN THE DELETION OF ALL SOFTWARE AND DATA THAT RESIDED ON THE COVERED EQUIPMENT PRIOR TO SERVICE. YOU WILL BE RESPONSIBLE FOR REINSTALLING ALL OTHER SOFTWARE PROGRAMS, rules and regulations related to cancellation or delivery of ordered items. You are responsible for maintaining Your own records for all such transactionsDATA, AND PASSWORDS.
3.4 (vii) You will maintain internal support staff that has the skills and experience to determine whether or not an issue affecting the Covered Equipment is eligible for repair or replacement service under the terms of this Plan. Failure to correctly diagnose issues that are ineligible for repair or replacement service under this Agreement may result in additional charges, as described in section 5 above, or cancellation of the Agreement if repeated failures are not corrected.
(viii) You will maintain, at the address you provide to Apple, your records relating to parts and service provided under this Plan for at least five years. Upon Apple’s reasonable request, during the term of this Plan and for five years after its expiration or termination, you will promptly provide copies of any refunds requested records. Apple will have the right to end-users inspect your facilities at any time during regular business hours for purposes of Your Application, and You agree that Apple may issue refunds to end-users in accordance verifying your compliance with the terms of Schedule 2this Plan.
3.5 You may provide Apple, its subsidiaries, and agents with end-user consumption information from Your Application in order to inform and improve the refund process and purchase dispute process. You shall provide notice to the user and/or obtain consent from the user in compliance with the Documentation and applicable laws.

Your Responsibilities. 3.1 For each successfully completed transaction made using To receive service or support under the In-App Purchase APIPlan, Apple will provide You with a transaction receipt. It is Your responsibility to verify the validity of such receipt prior to the delivery of any content, functionality, or services to an end-user and Apple will not be liable for Your failure to verify that any such transaction receipt came from Apple.
3.2 Except where Apple displays system user interface elements, You are responsible for developing the user interface Your Application will display to end-users for orders made through the In-App Purchase API. You agree not to misrepresent, falsely claim, mislead or engage in any unfair or deceptive acts or practices regarding the promotion and sale of items through Your use of the In-App Purchase API, including, but not limited to, in the Licensed Application Information and any metadata that You submit through App Store Connect. You you agree to comply with all applicable laws the following:
(i) Provide your Plan Agreement Number and regulationsa copy of your Plan’s original proof of purchase, including those in any jurisdictions in which You make content, functionality, services or subscriptions available through if requested;
(ii) Provide information about the use symptoms and causes of the In-App Purchase APIissues with the Covered Equipment;
(iii) Respond to requests for information, including but not limited to consumer laws and export regulations.
3.3 Apple may provide hosting services for Non-Consumables that You would like to provide to Your end-users through the use Covered Equipment serial number, model, version of the In-App Purchase API. Even if operating system and software installed, any peripherals devices connected or installed on the Covered Equipment, any error messages displayed, actions taken before the Covered Equipment experienced the issue and steps taken to resolve the issue;
(iv) Follow instructions Apple hosts such Non- Consumables on Your behalf, You are responsible for providing items ordered through the In-App Purchase API in a timely manner (i.e., promptly after Apple issues the transaction receipt, except in cases where You have disclosed to Your end-user that the item will be made available at a later time) and for complying with all applicable laws in connection therewithgives you, including but not limited toto refraining from sending Apple products and accessories that are not subject to repair or replacement service and packing the Covered Equipment in accordance with shipping instructions;
(v) Update software to currently published releases prior to seeking service; and
(vi) Make sure to backup software and data residing on the Covered Equipment. APPLE MAY REINSTALL THE COVERED EQUIPMENT’S ORIGINAL SOFTWARE CONFIGURATION AND SUBSEQUENT UPDATE RELEASES WHILE PERFORMING SERVICE, laws, rules and regulations related to cancellation or delivery of ordered items. You are responsible for maintaining Your own records for all such transactionsWHICH WILL RESULT IN THE DELETION OF ALL SOFTWARE AND DATA THAT RESIDED ON THE COVERED EQUIPMENT PRIOR TO SERVICE.
3.4 (vii) You will maintain internal support staff that has the skills and experience to determine whether or not an issue affecting the Covered Equipment is eligible for repair or replacement service under the terms of this Plan. Failure to correctly diagnose issues that are ineligible for repair or replacement service under this Agreement may result in additional charges, as described in section 5 above, or cancellation of the Agreement if repeated failures are not corrected.
(viii) You will maintain, at the address you provide to Apple, your records relating to parts and service provided under this Plan for at least five years. Upon Apple’s reasonable request, during the term of this Plan and for five years after its expiration or termination, you will promptly provide copies of any refunds requested records. Apple will have the right to end-users inspect your facilities at any time during regular business hours for purposes of Your Application, and You agree that Apple may issue refunds to end-users in accordance verifying your compliance with the terms of Schedule 2this Plan.

If we observe or suspect the presence of contaminants not anticipated in our Agreement, including but not limited we may terminate our work without liability to consumer laws you or to others, and export regulationswe will be paid for the services we have provided.
3.3 Apple may provide hosting Neither this Agreement nor the providing of services for Non-Consumables that You would like will operate to provide to Your end-users through make us an owner, operator, generator, transporter, treater, ▇▇▇▇▇▇, or a disposal facility within the use meaning of the In-App Purchase API. Even if Apple hosts such Non- Consumables on Your behalfResource Conservation Recovery Act, You are responsible for providing items ordered through as amended, or within the In-App Purchase API in a timely manner (i.e.meaning of any other law governing the handling, promptly after Apple issues the transaction receipttreatment, except in cases where You have disclosed to Your end-user that the item will be made available at a later time) and for complying with all applicable laws in connection therewithstorage, including but not limited to, laws, rules and regulations related to cancellation or delivery disposal of ordered itemshazardous materials. You are responsible for maintaining Your own records for all such transactionsagree to defend and hold us harmless from any related claim or loss.
3.4 You will If, during the term of this Agreement, circumstances or conditions that were not issue any refunds originally contemplated by or known to end-users the Consultant are revealed, to the extent that they affect the scope of Your Applicationservices, compensation, schedule, allocation of risks or other material terms of this Agreement, the Consultant may call for renegotiation of appropriate portions of this Agreement. The Consultant shall notify the Client of the changed conditions necessitating renegotiation, and You the Consultant and the Client shall promptly and in good faith enter into renegotiation of this Agreement to address the changed conditions. If terms cannot be agreed to, the parties agree that Apple may issue refunds either party has the absolute right to end-users terminate this Agreement in accordance with the terms of Schedule 2Termination provision herein.
3.5 You may provide Apple, its subsidiariesInasmuch as the remodeling and/or rehabilitation of the existing structure requires that certain assumptions be made by the Consultant regarding existing conditions, and agents with end-user consumption information from Your Application in order because some of these assumptions may not be verifiable without the Client's expending substantial sums of money or destroying otherwise adequate or serviceable portions of the structure, the Client agrees to inform bear all costs, losses and improve expenses, including the refund process and purchase dispute process. You shall provide notice to cost of the user and/or obtain consent Consultant's Additional Services, arising from the user discovery of concealed or unknown conditions in compliance with the Documentation existing structure or site.
3.6 The Client shall furnish, at the Client's expense, all information, requirements, reports, data, surveys, and applicable lawsinstructions required by this Agreement. The Consultant may use such information, requirements, reports, data, surveys, and instructions in performing its services and is entitled to rely upon the accuracy and completeness thereof. The Consultant shall not be held responsible for any errors or omissions that may arise as a result of erroneous or incomplete information provided by the Client and/or the Client's consultants and contractors.
