▇▇▇▇▇▇ Leave. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections B, C and D above.
▇▇▇▇▇▇ Leave. Adjunct faculty may participate in the College’s shared leave program.
▇▇▇▇▇▇ Leave. For the purpose of this Employment Agreement, “Garden Leave” refers to that portion of any notice period during which Executive is relieved from Executive’s usual employment duties but remains an employee of the Company in a consulting role. During Garden Leave, the Executive shall not attend work, enter the Company’s premises, use Company’s property, or have business-related contact with the Company’s customers, suppliers, contractors, or employees of the Company, except as directed by the Company. If requested by the Company, the Executive shall provide advice and information related to prior work performed for the Company, report to work during Garden Leave at such time and place as the Company may require, and cooperate fully with the Company in helping it transition the Executive’s duties to others and retain valuable business relationships. During Garden Leave, the Executive will: remain a loyal employee of the Company; avoid conflicts of interest such as, but not limited to engaging in competition with the Company, assisting a competitor, or actively pursuing the creation or development of a competitive business enterprise; remain bound to all Company’s policies and the terms of this Employment Agreement; and, continue to receive his Base Salary, benefits and other regular compensation through the termination date, to the extent permitted by the plans and/or applicable law.
▇▇▇▇▇▇ Leave. 45.1 Subject to clause 44.2 Full Time Employees and Part Time Employees, including Fixed Term Employees and Maximum Term Employees, with at least 12 months of continuous service with the Employer, are entitled to two weeks of paid ▇▇▇▇▇▇ Leave in any 12 month period where:
(a) the leave is associated with the placement of a long-term ▇▇▇▇▇▇ child with the Employee; and
(b) the Employee has or will have a responsibility for the care of the child.
45.2 ▇▇▇▇▇▇ Leave is only available if the child to be fostered:
(a) is, or will be, under 16 as at the day of placement, or expected day of placement of the child;
(b) the ▇▇▇▇▇▇ care is long term;
(c) the child cannot live with their families and require a permanent ▇▇▇▇▇▇ family; and (d)
45.3 An Employee and Employer may agree, , for an Employee to access Parental Leave for a pending adoption under clause 43 in lieu of ▇▇▇▇▇▇ leave where the child being fostered is less than 12 years old.
▇▇▇▇▇▇ Leave a. Australian Unity recognises the rich, diverse and ongoing Aboriginal and ▇▇▇▇▇▇ ▇▇▇▇▇▇ Islander cultures. We also recognise that reconciliation between Aboriginal and ▇▇▇▇▇▇ ▇▇▇▇▇▇ Islander peoples and other Australians is vital to our future as a nation.
b. Australian Unity provides a single day's paid leave each year (non-accruing) to permanent employees to attend a NAIDOC related activity. This leave must be taken within a single calendar day for the purposes of recognising NAIDOC and/or celebrating Aboriginal and ▇▇▇▇▇▇ ▇▇▇▇▇▇ Islander cultures (NAIDOC leave). .
▇▇▇▇▇▇ Leave. ▇. ▇▇ any time after notice to terminate the Employment is given by either party under clause 12 above, or if the Executive resigns without giving due notice and the Company does not accept his resignation, the Company may, at its absolute discretion, require the Executive to take a period of absence, called garden leave, for some or all of the remaining period of notice pursuant to clause 12, which for the avoidance of doubt could be for a maximum period of 12 months (pursuant to clause
▇▇▇▇▇▇ Leave. 283. If an employee has no other paid leave credits (e.g. annual leave), an employee may take up to two days unpaid pre-▇▇▇▇▇▇ leave to attend interviews or examinations to assist the employee to obtain approval to ▇▇▇▇▇▇ a child.
▇▇▇▇▇▇ Leave. ▇▇.▇. ▇▇ any time after notice to terminate the Employment is given by either party under clause 20 above, or if the Employee resigns without giving due notice and the Company does not accept his resignation, the Company may, at its absolute discretion, require the Employee to take a period of absence, called garden leave, for some or all of the remaining period of notice pursuant to clause 20, which for the avoidance of doubt could be for a maximum period of 12 months (pursuant to clause 20.1) (the “Garden Leave Period”). The provisions of this clause shall apply to any Garden Leave Period. During the Garden Leave Period, the Employee will be entitled to receive full remuneration (other than in respect of bonus and other incentive arrangements for which the discretion of the Compensation Committee will remain) in accordance with the terms of this Agreement, any unused holiday accrued at the commencement of the Garden Leave Period and any holiday accrued during any such period will be deemed to be taken by the Employee during the Garden Leave Period. At the end of the Garden Leave Period, the Company may, at its sole and absolute discretion, pay the Employee full remuneration (as defined above) in lieu of the balance of any period of notice given by the Company or the Employee (less any deductions the Company is required by law to make).
21.2. The Company may require that the Employee will not, without prior written consent of the Manager or as otherwise permitted pursuant to clause 16 above, be employed or otherwise engaged in the conduct of any activity, whether or not of a business nature, during the Garden Leave Period and further, if so requested by the Company, the Employee will not:
(a) enter or attend the premises of the Company or any other Group Company; or
(b) contact or have any communication with any customer or client of the Company or any other Group Company in relation to the business of the Company or any other Group Company (other than purely social contact); or
(c) contact or have any communication with any employee, officer, director, agent or consultant of the Company or any other Group Company in relation to the business of the Company or any other Group Company (other than purely social contact); or
(d) remain or become involved in any aspect of the business of the Company or any other Group Company except as required by such companies. Initials Employer: AM Initials Employee: PB
