THIS FREQUENCY RECONFIGURATION AGREEMENT (this “Agreement”) is made as of this day of , 2008 (“Effective Date”), by and between the County of San Bernardino, a political subdivision of the State of California (“Incumbent”), and Nextel of California, Inc. (“Nextel”), a wholly owned indirect subsidiary of Sprint Nextel Corp., a Kansas corporation (each is referred to in this Agreement as a “Party” and together as the “Parties”).
