This Business Associate Addendum (“Addendum”) supplements and is made a part of the Underlying Agreement (as defined below) by and between the Merge Customer as identified on the applicable Sales Order and/or other Underlying Agreement (“Customer”) and Merge Healthcare Solutions Inc., an IBM Company (“Business Associate”). Business Associate and Customer may be referred to individually as a “Party” or collectively as the “Parties.”
