THIS SOFTWARE SUBSCRIPTION LICENSE AGREEMENT, is dated as of the date of, in the case of any Evaluation Software (as defined in Section 16 below), the date of Customer’s acquisition of a License Key, or in the case of any purchase of a license for use of the Licensed Software (as defined below), the date of the Order Form (as defined below) pursuant to which such license is purchased, is between Embarcadero Technologies, Inc., a Delaware corporation (“Embarcadero”), and, in the case of any Evaluation Software, the customer to whom temporary Licenses Keys are delivered or, in the case of any purchase of a license for use of the Licensed Software, the customer set forth on the purchase order pursuant to which such license is purchased (in each case, herein “Customer”), and sets forth the terms and conditions whereby Embarcadero agrees to provide to Customer and Customer agrees to acquire from Embarcadero one or more limited licenses to install and use certain software and documentation a
