THIS AGREEMENT (hereinafter the “Contract” or the “Agreement”), by and between the People of the State of New York, acting by and through the Commissioner of the Office of General Services (OGS), whose office is on the 41st Floor, Tower Building, Governor Nelson A. Rockefeller Empire State Plaza, Albany, New York 12242 (hereinafter referred to as the “State” or “OGS”) and Metropolitan Foods d/b/a Driscoll Foods, having its principal place of business at 174 Delawanna Avenue, Clifton, New Jersey, 07014 (hereinafter referred to as the “Contractor”). OGS and the Contractor are collectively referred to as the “Parties.”
