This Memorandum of Land Use Restriction Agreement (“Memorandum”) is made and entered into as of [MONTH][DAY], [YEAR] by and between the NEBRASKA INVESTMENT FINANCE AUTHORITY, a body politic and corporate, not a state agency, but an independent instrumentality exercising essential public functions under the laws of the state of Nebraska (the “Authority”) and the OWNER IDENTIFIED BELOW (the “Owner”) of the rental housing development (the “Project”) located on the property (the “Property,” and together with the Project, the “Premises”) described in Attachment I (“Attachment I”) to provide record notice of certain restrictions with respect to the transfer by the Owner of the Premises hereto, who acknowledge and agree as follows:
