THIS AMENDED AND RESTATED PAYMENT IN LIEU OF TAX AGREEMENT (this “Agreement”), made and entered into as of this January 1, 2020, by and between KG PROPERTIES LLC, a Kansas limited liability company (the “Tenant”), and THE CITY OF BONNER SPRINGS, KANSAS, a municipal corporation (the “City”), amends, restates and replaces the Payment in Lieu of Tax Agreement, dated as of December 1, 2019, by and between the Tenant and the City.
