Post-Confederation treaties concluded between the Crown (in right of Canada) and various Indian nations in the Prairie provinces, parts of Ontario, British Columbia, and the Northwest Territories – the so-called numbered treaties – all stipulated the reservation of land for the benefit of Indian bands. In all cases, the size of these allotments was to be determined accord- ing to a formula of a stated area for each family of five persons, “or in that proportion for larger or smaller families.” Treaties 1, 2, and 5 set aside 160 acres per family; the others set aside one square mile or 640 acres per family.
